Does any body know, if a person needs a 140 receipt to apply for 7th year extension on pre-approved labor. Is it enough to attach the pre-approved LC? Or should I wait for 140 receipt number?
Any help is greatly appreciated.
Thanks

NOT mendatory...
You can file both online....then u will get receipt numbers on web it self.

while sending documents u can add if u like to keep receipts

Based on LC, one year extension is possible.
After 365 days of I140 receipt, one year extension is possible.
It is a labor substitution in your case, check with lawyer/attorney. Make it sure, date of acceptance of the LC must before 365 days to get extension.

Thanks for the reply.
Its been a little more than 365 days since the company applied for that labor and it is approved before 365 days. The lawyer says that we have to apply for 140 and wait for a week to get the receipt number and then file h-1 even if we din't get the receipt number by that time. He says that we can submit the receipt if we get an RFE in future. Does it make sense to you?

Thanks to AC-21. If your I-140 is pending you will get three years extension. Better apply with receipt.

tammy2,
suppose if i am in EAD now and wants to change to H1 with 8th year extension of preapproved labor which is in 2003 PD,
once we file 140, get the receipt of 140 and then file for H1 Extension?

then what i have to put about my status in 140 form?
my 485/140 got denied ,then what info we have to put?

Thanks for posting that Memo UN...!!!

Could you please clarify this one for me please ?

Say..I am in 7th year with company A based on a pending labor. Another company B wants to file my labor through PERM and subsequent I140 after Labor approval. Can I take an extension based on B's approved labor or approved I-140 ? Labor wouldn't be 365 days older in that case but there is a possibility of approval of I140 with in a year. Do you think I'd be able to transfer my H1 to "B", get extension and start working for them ??

your comments are highly appreciated..
Thanks..

i believe the 140 has to be approved to get the 3 year extension.

They are giving three years extesnsion even if I-140 is pending. Might be side the of Con-current filing.
