I was married in 1996,got divorce which was nasty, was granted conditional GC,which was renew once . I went up to immigration in 2003 for removal of condition of my permanent staus, they took my green card and say i will hear from them, up to now i can't hear a thing, any decision what so ever, i fill out the info pass and they said they can't find my file. On the other hand i have my mother who is a US citizen, can she file for me.? even though i have this long case going on. Its been almost 11 years now, and can't hear a descision. Please any advise.

Hi realr,

[EDIT: I just read your other thread, try to keep your related questions in the same thread!]

As a permanent resident you can't file for AOS so unless your GC was revoked your mother can't petition for you. If your GC is revoked, you may qualify under the first family preference category based on your mother, which has a 6-17 year wait depending on your country of origin and you'd need to have a valid status in the meantime to stay here, or you have to go back and wait. If you accrue unlawful presence in the process, it may be be difficult to apply through your mother because you don't qualify in the immediate relative category as an adult son/daughter of a citizen.

Your best scenario really is applying for citizenship as was suggested in the other thread!

Thank you very much for your respond. My GC was not revoke, they just took it and the continued to stamp my PP stating I-751 pending and i will hear from them.
