ND 09/26/2002 Approved Finally!

Friends, finally I got the good news (via four emails, two for me and two for spouse). Our I-485s were approved Dec 15th. Long long wait for the GC ( tried since 1996!) with many complex issues. There was no LUD change from Nov 5th 2002 when my first FP was updated. The next LUD was 485 Approval!

I applied for my 3rd EAD Dec 1, 2004. Maybe that opened the file and we got approved.

I used to visit this site atleast twice a day for the last 3.5 years. This is the most helpful site for immigrants. Thanks a lot to Mr. Rajiv Khanna for providing us with this help.


My only advice to those who are waiting. Keep calling INS, get your congressman involved. Dont wait for stuff to happen.

When you asked help from Congressman/Senator, what are the exact replies
/ responses you got ? Would like to hear if possible.

His office people used to email/call INS immediately and ask them the status. One lady (God bless her soul!) bugged the INS about our cases regularly. Initially we got the usual replies like "wait for 60 more days and if you dont hear from us, call us again" etc. But she still persisted and I think went to the higher ups. Maybe that's what helped us.

Two years back INS had misplaced my spouse's file for a J1 waiver and we did not hear from them for more than 1.5 years. She made them accept another copy and we got the waiver after 3 months.

Someone in your circle , your bosses for example will know a congressman/senator well. My advice is to go through them if you can. Thats the only way INS will respond better.

I have met my local Congressman once face to face and have been
communicating with him for more than a year. The latest response I heard
is "your file was placed with an Adjudicating Officer on Dec 1....allow 60
more days to hear from us". Standard Status Enquiry has yielded
"Case pending Service Consideration". Problem is I have no clue what these
mean, and what they project or what's to be made out of them. Has
Name Check been initiated ? Responded to ? Just no way to correlate
these responses against what's going on. Do you think I should just fax
an Expedite Request ?

Problem is once you are with a certain Congressman, its probably not worth
changing that. And on the same Congressman, it seems kinda rude to
apply pressure from some influential community person.

Its 2 years 3 months since I applied I-485.....just clueless.

I too got all these replies. The final straw was last month I got a reply saying my file has been sent to the local office in NYC. I was totally frustrated since people who applied 485 at the same time as me got approved in 2 months. And here I was even after two years there was not even a LUD change. I was thinking of approching both the NY senators next month if nothing happens.

I never did any Name check/ Expedite etc. I dont know how far that helps. It could be good since all the enquiries go on your file. And I think it is better to use more influence than less. Enquiries from two congressmen/senators will carry more weight in this country.

Dont think it is rude to use any sort of influence. Take all the help you can get.

I have been told that you cannot pursue any Congressional effort through
2 windows. In other words, if one Congressional Office is pursuing it, one
needs to close it down before pursuing another diff one. Reason being
the Congressional Liaison at USCIS needs only one Congressional window
for a case and never more.

Have you heard this too ? Just checking/confirming I guess !

Also how long back did you hear Congressman telling you "file placed
with Adjudicator" ? And how long after you heard that one did your
approval come ?

Did you e-mail FBI about name Check ? How long did it take you to get
e-mail response ?

I did not know that you can go through only one Congressional window. It is just my opinion to use any and all influences you have.

It took more than (approximately) 2 months after I got that message.

No, I did not email the FBI at all about name check. My spouse called the phone number regarding finger prints (FP2) and they confirmed they sent it to the INS the next day or so.

I have been hanging in right here ( don't know where exactly though ) since
July 1999. Now fate is hanging me with a noose around my neck. Or at least
that's the feeling I get.
