Hey! Im a U.S. resident. I got my green card because my dad married a U.S. citizen. Right now im 18 years old. I was wondering, under wich category do I fall for naturalization? Is it by living here for 5 years (most common one) or can it be the one in which I have to live here 3 years to become a citizen? Im not sure but I thinks it is in the 3 years category because for the green card my stepmom gave it to me too! Or maybe because now Im older I can get I that way? What do you think? Thank you.

JoeF,

You raise an interesting point. If his parent became a U.S. citizen (which he doesn't hint at all in his message) before he turned 18 I think the citizenship is granted automatically by law without need of an application. I don't know what happens if someone's father marries a U.S. citizen, then obtains a GC. Would this person fall under the category of becoming U.S. citizen by having a GC and a U.S. citizen parent (stepmother)? Would that stepmother qualify as parent for the purposes of the Child Citizenship act?

Perhaps, if he became a permanent resident before turning 18, and if the stepmother is considered a parent under the Child Citizenship act, he could have become a citizen automatically already.

This is not legal advice, just an idea. Please change his/he to her/she if appropriate.

My 2 cents.
