Naturalization interview - asking for change of date and place?

Hello,

My wife sent her N-400 application around end of July 2007 to Texas Service Center (at that time we lived in Miami, South Florida). She had her fingerprints done in January 2008. Since that time we have not heard anything from USCIS until today.

About a month ago, we moved to Chicago. We submitted the change of address form via their website (May 12th).

Today we received an invitation for an interview, but for some reason they scheduled the interview in Miami, instead of Chicago. The notice date is May 7th, so I am just guessing that when we submitted the change of address form, her paperwork was already processd.

Anyway, we are thinking about re-scheduling the appointment due to her trip overseas - we talked about changing our travel plans, but this is too complicated.

I am planning on sending the letter to the Miami office asking for a new date for interview and for changing the place (i.e. to have the interview done in Chicago, instead of Miami).

Did anyone have any similar experience?

Also, anyone know how long could it take for them to schedule another apointment?

Last question is if perhaps instead of sending the letter, we should make the InfoPass appointment in CHicago?

Make an InfoPass appointment to the Chicago USCIS District Office as well. For that appointment, take a copy of the AR-11 address change you made for proof of address change and bring the interview letter as well. Ask your new local office to transfer your file to their office and to put you in the queue for an interview. Make sure you put all this in writing and present that to the IO at the information desk. Also make sure you keep copies.

This should be done in addition to sending the letter to your former Miami USCIS DO. What I do know is that Miami may sit on your case and not process anything. However, if Chicago gets involved, they can initiate the transfer process since you are in their jurisdiction now.

One more thing that comes to mind is whether or not you have to satisfy the 90 residency requirement required to file the N-400. This is a gray area and I honestly don't know if they will make your wife wait 90 days before scheduling her new interview in Chicago so that see meets the jurisdiction residency requirement.

You may have submitted an AR-11, but for some reason your N-400 case files have not been updated with the new address. Whatever happens, DO NOT attempt to go to the interview in Miami, because the IO will simply terminate it immediately for lack of jurisdiction.

Take an Infopass at your local DO. Explain the situation and give them a copy of your AR-11. There will be a delay before you can be rescheduled, but there's not much you can do about that now anyway.
