Naturalization Certificate Question

Hi Everyone,

My wife was naturalized today at Newark NJ. Her timeline was:
RD: 04/08/04
PD: 04/08/04
FP: 07/10/04
Interview: 01/18/05

She was asked 3 questions from the pool. and was done with the oath by 5 PM (we went in at 1 for a 1:33 :) appt)

Here's the problem and the question - the N-400 we submitted didn't ask for our marriage cert (I'm on a H1B and we were married in India), neither did the letter calling her for he interview mention that it was required (except for applicants on the basis of marriage). Unfortunately, we didn't think of carrying it.

So the interviewer said she would either ask us to reschedule and come back with the proof of marriage to mark marital status as 'married' OR she said she'd put down status as single and that we could submit a form (the number of which she didn't recollect), pay a fee, and provide a copy of the marriage certificate to have it amended. My wife asked if that (option 2) would have any problems for my application of I-130/485 etc based on her naturalization and she said it wouldn't. So my wife picked the 'red pill' option 2.

Does this have an impact on my application? From my trolling of this board, I've never heard of this happening before, or of any such USCIS form. Am I screwed by filing my 130/485 with my wife's naturalization certificate which say's she's 'single' ???

Any experts/ others with similar experinces pleaase chime in - I'm oscillating between elation and a 'I'm so screwed' feeling

Thanks.

PS: I'll post a link to this in the Newark tracker for thsoe that may be interested.

Same thing happened to us on I-485 interview. Even though we weren't required to submit our marriage certificate, the interviewing officer decided to see it. Fortunately, the person, who filled out the papers for us, was not very far from the District Office, and she happened to have a copy of our marriage certificate. So, we went to her office, got the copy and the translation of the certificate and took it to the officer, who then did the rest of the paperwork...
That was a long time ago. I did not know much about the immigration paperwork, and I was not the one filling out the papers. But if that happened on my citizenship interview, first I would request to see a paper according to which I was supposed to submit my marriage certificate, second, I would never complicate my life putting "single" for my marriage status, especially if my husband needed to get his permanent residency based on the marriage.
But, what's done is done. I think, you should wait until she gets her marriage status corrected, and then file I-130/485.

The best of luck!

Thanks Anahit for the detailed response.

My wife's now wracked by guilt :( We did speak with an immigration attorney that we know, and he suggested that we go ahead and file the I-130/485 using the Cert. of NAturalization, and that if we were ever questioned, he would argue using our N-400 copies (on which we declared that we were married) and the letter for the interview, neither of which asked for the marriage certificate for cases not based on marriage.

So, it's a little bit of a consolation, we'll roll the dice, and hopefully it won't be too hard :)
