I just received a response from FBI, Washington DC, for the call I made last week regarding my name check. The lady told me that my name check was completed on 1/9/2003 and the results sent back to INS.

I asked her wether it was 2003 or 2004, and she confirmed that it was 2003. My second FP was taken in Sep, 2003.

What number did you call regarding name check? Is it the same number for finger print?

I don't know what to do now....

I received a call from FBI last week that they have never received any request from USCIS to complete a name check in my case. Today I received an e-mail from FBI confirming the above fact.

I have been waiting for adjudication for my case since January 2003 (yes 2003) when I had my interview at Chicago. The USCIS has repeatedly advised the US Senator Dick Durbin's office that my case is pending due to non-receipt of secondary security check results from FBI.

Now that USCIS has proven that even the members of highest legislative body of the country are not immune to its apathy, I feel totally dejected and helpless.

Any suggestion guys as to what should I do now?

You could take the e-mail to the senator's office and tell whoever was following up your case that the BCIS had by oversight never sent your case to FBI for secondary processing (a euphemistically polite way of saying that not only did they screw up, they've deliberately been covering it up) and if they could please follow up again with the BCIS to send your case to the FBI. Maybe he/she would also recognize a spade for a spade, even though you aren't calling it, and somehow bring some pressure to bear on them.

I can understand how you feel. Hopefully this would do it.

cmr, is "Name check" done along with FP verification by FBI, or is it separate request to FBI from INS. what is the purpose of "Name check"? is this part of background check?

I spoke to an FBI person last week who gave me similar time frames as yours.

My name check December 2002
Wife (derivative) name check January 2003

So your time frame for name check is plausible

To the best of my knowledge, Name check is a seperate search made by FBI(at INS'S request) on the applicant's name in various combinations of first and last names and close variations to see if it results in a "hit"(match with some potential criminal/terrorist). It is done for every 485 applicant these days. There is a ton of information on FBI's website about this process.

Muract, thanks for the info. I think that's true, and I believe Name Check process is not necessarily the reason for delay in most of the pending cases.

FBI Telephone # for name check

You may call tel.# 202-324-2399 and leave your information viz. Name, date of birth & A# and call back number. Someone from FBI will call and inform when the name check was completed.

Name check is different from FP Check. FP check is done only to confirm that no criminal record exists in the National Crime Database which is maintained by FBI. It is an automated process and usually INS gets the results from FBI within 24-48 hours.

Name Check is also called as "Secondary Security Check" and is done by FBI. As the name suggests, it was a 2nd level check being done earlier in a few cases on a random basis, if there was any hit during FP check or the Immigration Officer had some issues concerning the file and/ or the applicant. Since January 2003, this check is no longer secondary as USCIS is requesting this invariably in all cases. This process takes anywhere from 1-3 months due to manual checks involved in scanning the domestic as well as international criminal/ terrorist database maintained by FBI, CIA and other intelligence agencies.
