Name Check Vs Background Check for I-485

Hi,

I-485 : VSC RD : 5/2004, I-140 cleared

My Name check was done last year 11/2005. After that I was expecting that
approval can happen anytime. My PD is 8/1997.

I put enquiry a month back and today rcvd response that
my Background check is still pending .

Aren't name check and Background check same?

What is different between them? How to get background check info?
Who does this check ?

Please share your experience.

I received letter yesterday with same info. Background check pending for my enquire..

My application is also undergoing "background check" in texas service center. I had asked the operator if background check is same as name check. She said they are different.

I had posted this same question in the texas service center forum. From what I learned there it looks like the background check is done by CIA to check for criminal record.

Can you tell me how you filed an inquiry with USCIS? I also want to do it. (I could not find any info on the USCIS website for making a written inquiry)

I am from India. I called USCIS toll free number and requested customer support for
status.

Then I got response back that background check is pending.
Long time back, one of Immigration Officer ( not cust support) told me that my
Name check was done and USCIS has received it on 11/2005

Is it ok to contact local congressman/Senator ?

Sdbubey, can you pls tell me what USCIS number you called? Was you able to find out your background check info right on the phone?
 
What might work?

Folks,

My reading so far shows that you can try to contact FBI for expediting name check - use their fax number - it is there on www.fbi.gov website - instead of slower snail mail that goes through a holding period (bio-terror threat). You can't email them and they won't entertain you on phone either.

They have established a criteria for expediting requests and the ones that sound reasonable to AOS applicants is a pending lawsuit in a federal court (means $$$$$$$$). Other reason - critically ill. Or military service.

Mandamus writ is one way out - it generally produces a result.

Else - a case file - which for some reason generated a :reference: (or even a :hit: - in case the applicant is a prime suspect somewhere) must be lying in a heap under Agent X's desk and Agent X contemplates the beauty of a sun set on a guided cruise through the Carribeans.

Nah - it is not happening in a month's time. Or even a year's time.

I am stuck in name check quicksand for the last 3 years. I am trying the
congressman route - but I am not hopeful there, since FBI's FAQ clearly states that congressional help won't expedite cases.
