Name Check victim asking for input

Hi folks, I need your advices regarding my pending name check.

For background I am EB3 Row; PD Jan 03; 485 RC date May 9th 2007.
I found out through 2 infopass that my background/name check is still pending :eek: It's been 4/5 months since I applied.

Reading the various post I understand there's not much to be done but to start firing desperate & frantic mails to Ombudsman, Opening a SR, writing to FP, Senator, Congressman...hoping that it may have an impact :eek:

My questions:
1) Do I have to wait 180 days from RC date to start these various steps/mails (specifically open the SR)
2) Will these contacts/steps actually help with my FBI name check problem (& not USCIS)
3) Would you know any link where I can find info regarding adresses or template letters to send

Any help would be much appreciated

a) I should have insisted & apply as EB2 against my lawyer strategic reco !!!!
b) Hope none of you will get stuck in NC, but as FYI for all of you; it seems to be an extremely random process (my name is very European and yet not so common, I never visited any exotic country and can guarantee I have no criminal record anywhere in the world).
 
You are not a victim of NC! Your case is well within processing dates. When your case is 30 days past published processing dates, then can start doing inquiries. Anything before that wil fall on deaf ears.

There are lots of people who've been stuck in NC for much much longer (3 - 5 years), they are NC victims, not you, not even me (16 months is baby time in NC black hole).

You don't have to wait for a certain amount of time before writing letters to your senators and congressmen, but I seriously doubt they help much, if at all. Many offices don't even inquire with the FBI if you name check is pending less than a year or so. Also 5-month may seem a long time to anyone, especially if you are anxiously waiting for the GC, but it is actually quite normal for FBI to take anywhere from 3 months to one year to clear a name check.

There have been some talks about USCIS/FBI taking initiatives to speed up the NC process within 2-3 months, but no official words on their exact actions. It is worth watching.

I agree that EB2 might have been better - some attorneys have weird thinking I guess. Also they make the same amount of money for filing EB2 or EB3, and EB3 is usually easier to handle. However, since you're ROW, and have a PD of 2003, you should be fine in terms of visa availability.

Thks for the semantic lesson !!! Granted that 'victim & stuck' are probably strong words for my case, my point being that I'd prefer not to become a victim and wait 2/3 years before re-acting on the issue.
After reading several FBI docs and talking to IOs, it is clear that if a name is not cleared in a few weeks, it means there at least a 'hit' on the name and therefore not a good sign.

I gather from Koku1, that it is not the 180 + 30 days rule from RC that applies but rather the published processing time that count to make these (useless) inquiries. I was under a diff impression, can someone validate ?

koku1 is right.

The case processing times published monthly by each service center specify the 'receipt date' of the cases that they are currently adjudicating. So calling up and asking them about cases that were filed later than that will probably get you rather curt responses from customer service. If you ask about your case, the first thing they will check (after they ask your case's receipt date) is the processing times bulletin. So you can save them the time and energy and check it yourself and decide if your case has fallen behind their published processing times.

The only exception to this, that I can think of, is 'premium processing' of certain applications.
 
Sorry, is it only through INFOPASS that you can learn if your case is stuck at name check? Wouldn't it show in your case online portfolio?

I just got and LUD today (09/18/07) and wondering what it mean because nothing changed in the case status and text.
