Name check stuck, what can we do?

I am in the same boat

I am in a similar situation. According to my inquiry with the FBI they received
my Name Check request from CIS in January 2003 and it is still pending.
Of course, I have no cirminal or other derogatory record whatsoever. My name,
while not too uncommon, is not the most common name either so I can not imagine
why it would still be pending (19 months so far). Congressman is of no help with
FBI either.
Are you from a special registration country? I am and I suspect they are keeping
certain nationallities on purpose but I have no way of confirming this (short of a
lawsuit perhaps).

You mentioned lawsuit, what do you mean? It might be a good idea. Since the lawsuit against USCIS, it works much better.

Hi Guys.
1) Do you know how you got the status of your name check status. Is there a number to send the fax to.
2) Secondly are you sure that it is stuck in namecheck. Maybe they have no info about it. Cant you talk to your consulate and see if they can help.

Noticed from your posting that we both have the same ND of 11/30/2001. My case is also yet to be approved, though I have had no employer changes, no location changes, not even address changes..and if it matters anyway I am not from any special registration country. Looks like our case is lying with some ultra-inefficient fellow. I see that most people are getting approved within weeksof RFE reply receipt and here I am getting into 17 weeks since then. My phonecall resulted in an FP2 recently on 07/15/04 and online status indicated they received the results and who knows how long the further wait will be. I see that some/most people get approval after 1 or 2 months of FP2, so don't see any point in hoping that mine will be done in that time frame, based on others'. As CIS says, each case is Unique !!
