Name Check response from FBI, Help!

I received the following email from FBI today, Does anyone receive the same email before?

Dear xxx,

I am responding to your email dated January 6, 2005, concerning your
name check status for immigration purposes.

A review of our the FBI's Name Check Program database revealed that a
request from the U.S. Citizenship and Immigration Services (USCIS) for
you was received on October 3, 2003. This submission contained an error
and was not accepted by our automated system. Our records do not show
any further resubmissions. Therefore, you may wish to recontact your
local USCIS office for further processing of your case.

That is what I am always afraid of. Now is the time to call your senator, congressman, USCIS and consider filing a case. It is really unfortunate.

Call your senator and congressman, put no excessive hope on USCIS. You might want to explore a lawsuit option.
 
First take a printout of the email, send it to your attorney. Ask him to write a letter to TSC with details requesting to resubmit. If you don't see any progress (unfortunately in most of the cases), then explore other options.

I am sorry to hear of your situation. I just can't believe our futures are in the hands of such incompetent people. At this point I think you need to write a letter to your area congressman or senator along with the copy of the email you received from the FBI. You should also push your lawyer to start a AILA inquiry into why TSC has not requested your name check again once it was rejected from the system. You should also get your laywer to write a letter to the TSC but from experience I can tell you that this has no effect. There is no harm in trying though.

The key is that you will have to be very aggressive. The TSC RARELY corrects any mistake on their own. Once something goes wrong with a case, the filer has to fight to get it corrected. It is not fair but such is the system.

Thank you so much for the reply. I forwarded this email to my attorney, and here is his response:

Dear XXX:

We can follow up with CIS. However, you should not be overly concerned
about such a response from the FBI. We've received several like that
ourselves, where the FBI did, in fact, already clear the fingerprints.

I am waiting for the follow up from my attorney. In the meantime, I did make a infopass on July, 1st. I am going to talk to CIS officer in San Antonio, hopfully, they can give me some information.

FP is different from name-check

Your attorney does not seem to know the difference between name-check and finger printing. You may educate him on this matter and ask him to follow up with USCIS for initiating your name-check.
I had to fill up a request form at Dallas local office for initiating name-check for my younger son who was 14 at the time of filing I-485 and is now 16 years old. ( TSC forgot to initiate the name-check and kept waiting for the results :mad: )
 
And he is not the only such attorney. My attorney belongs to the same league, where the client knows more about the process than the attorney.
