Name check FINALIZED and CIS HQ

Does anyone know how much time the USCIS HQ takes after FBI says that the name check has been cleared.I received a letter from FBI that says that my namecheck was FINALIZED and results sent back to the USCIS HQ on the 29 May 2006.But when I contacted my service center to check if they can adjudicate my pending I-485, they have replied back saying that their records still indicate that the FBI name check has not cleared and that the HQ is reponsible for updating the name check status. IT has been over 3 weeks since FBI has sent them the results. This whole system is so damn screwed up. CIS blames the FBI for the delays and now that FBI has cleared the checks, I dont know what I will have to do to get CIS to look at the results.

Does anyone know how much time CIS HQ takes to update the status saying that the namecheck has cleared once FBi sens the results over?

Finding out the name check status was not a problem.I found out that my 485 was pending due to name check from the status replies that I got from the USCIS local service center. I was filing an inquiry with them every 4-5 months and they would respond that my 485 was pending as they were waiting results of the FBI name checks.
Starting some time in December last year, I went on a letter/email/faxes writing spree to the FBI, white house, senators, congressmen, anybody and everybody you can think of. Finally I dont know what worked.Some time in the first week of June, I got a letter from FBI that my name check has been finalized and results sent back to the CIS HQ on May 29 2006.
I wanted to try everything before considering WOM. I have invested a lot of time, effort and of course money and finally loks like the efforts have somewhat paid off. I must have written like 90-100 letters, about 50-60 emails and tons of faxes.

I am now waiting for the CIS HQ to update their dumb system that the FBI name check results have been recieved so that my local service center can finally adjudicate my case.

90-100 letters, about 50-60 emails and tons of faxes? great hard work which paid off I guess. Any idea what to write and how to pursuade them to do something for you? What's the overwhelming reasons?

I know I did something on Tuesday by faxing to Vermont SC although my case was transferred to local office. I do see cases are sent back once they are done with interviews. That's why I wanted to press them for expedite NC. However I got a reply this morning by fax saying the reasons of expediting have to be:
1) humantarian
2) extreme emergency
3) severe financial loss
4) service error (does not include data entry error)

So I guess mine was denied :mad:

Congratulations on clearing this major hurdle!
In my case, it took approx 3 weeks. After a week, I called TSC and they said the name check is still pending! then I asked my attorney to initiate an inquiry (aila)..when I called again by 3rd week, the lady told me that it is in their database..so if you have an attorney, give him some job..also keep calling service center and ask them if you could fax FBI letter to them.
You should hear good news in a couple of weeks!

You got the email from the FBI that your name check is cleared. It is most likely because of your other efforts. When you emailed the FBI, they may have cleared your NC. So they told you it was done. It is unlikely your email itself made your NC cleared. In other words, if the FBI still had not cleared your NC when you emailed them, they will not respond to your inquiry, just like most of people never get the FBI’s reply.

You may be right.But That is probably the only thing that I could do being stuck in the name check.Writing letters/emails/faxes was the onyl thing that I could do from my side. You are right.FBI could care less about those letters and I am sure most of them went straight to the trash bin.But I know that they do read your letters. I ams sure that they would start recognizing the names when they read letters from the same person over and over again.
Tell them how much suffering this has caused and how just that name check is holding up your entire process.
The idea here is to some how get them to look at your case. But something that I have noticed is that if your record is clean (no convictions arrests etc.), the case will be resolved in a matter of days when some one works on your case.Most of the time the delay is cause because of the sheer backlog sitting on their desks and your case just gets lost in that pile.I am sure that most of the pending cases can be resolved if someone just takes a look at them and spends some times to resolve the hits/idents. There are exceptions of course.But it is sure worth a try.

Thanks for the info. I has sent an inquiry email to them in the 3rd week after the name check cleared and they replied back saying that their system still indicates that the namecheck has not cleared. I had also faxed them a copy but they came back saying that USCIS HQ has to update the system and that till then they cannot do anything
I am planning to wait one more week (i.e end of this month) and then talk to my congressman to see if they can initiate an inquiry with the CIS HQ.

Writing to the Management of the FBI and USCIS or White House etc. to complain about the USCIS and FBI inefficiency may bring you different results. The question is how many other efforts you actually know and have tried yet?

Well my friend, my emails/letters to the white house and USCIS and FBI were not about complaning about their inefficiencies.I just highlighted the difficulties that I was facing by not having the name check cleared and how that it effecting my life.At no point did I mention their ineffeciency.
If you are scared about getting "unexpected results" just because you are writing to them and telling them how your life is being effected because of these delays and how you have been waiting in line for the past 4 -5 years , good luck to you. Suffering in silence is not my cup of tea and in this coutry no one really gives a damn unless you speak out.
The other option that I was willing to try out was the writ of mandamus. but I wanted to wait for some more time and try out all possible peaceful avenues before resorting to this approach. A lot of peopl have successfully done that and that is the ultiamte way to do it.

when you said life is being affected, can you please tell me what exactly it means? what the most overwhelming reasons that FBI and/or USCIS would properly buy? I know people are talking a lot about economically and emotionally loss. Any specific reasons? I know they vary person to person, but I just want to get good/better reason so that FBI/USCIS would mostly listen and utimately do something about the process. I like everyone else here will do something about it by writing to them. thanks a lot!

There is no one specific reason that holds good for everyone.I am sure everyone has their own personal reasons how not having a GC on time could effect you.I can just tell you how not having a GC will effect my life.It might not be true in your case.You really need to figure out those reasons urself.
In my case, it was my wife's career. It was in jeopardy if she could not get her GC on time. She is involved with projects that deal with war veterans and not having a GC is severely effecting her as she cannot work on projects that require atleast a permanant residency. My job requires a lot of international travel and I really cannot go through the hassles of wating for yearly renewals of Advance paroles.Also I cannot stay out of the country for extended periods of time.
These are some of things that I wrote in my letters.Like I said, everyone has their own reasons.

First of all, I would like to say "THANK YOU!" for sharing your story with me and others on this forum. You mentioned several reasons why you had been writing so many letters to so many places, however, I don't think one needs to have so many reasons to complain.

I believe it is ridiculous that it takes more than one or two years to wait for the 485-approval. Just imagine how bad you would feel if you had to wait for one hour or even one day to eat BigMac after you ordered it at McDonald's.

Many of us, or all of us who have filed 485 are people of good will and in some way are doing a good job here in the states. This means that faster 485 processing should benefit not only applicants, but also the society as a whole.

Although my case is not as bad as others (485 filing: August, 2005; NSC; EB-2 worldwide; FP Code 3: February, 2006), I would be happy if I got my 485 approved today.

Once again, thank you so much for your valuable information.

FBI Name Check Completed 30-months ago - I'm still waiting

I just wanted to share my story and see if anyone has any suggestions.

October 2001: Filed I-485
January 2003 : GC Interview (approved pending name check)
July 2004: FBI faxed me a letter informing me that my name check had been completed and that USCIS had been notified.

At this stage I was naively hopeful. However, INS repeatedly informed me that my name check was not complete. I spoke with 2 FBI analysts who assured me that my name check was complete - and so nothing happened wrt my case.

March 2005 - filed for advance parole (travel authorization) - I never ever heard from USCIS about this advance parole and lost my $165.

Around the same time my case was transferred to USCIS HQ (Washington DC) and the California center no longer has any jurisdiction over my case.

I contacted my senators and congressman and finally in December 2005 USCIS emailed senator Feinstein’s aide to say that my travel authorization was DENIED!!! and that I should be patient while they complete their investigations.

Over a year has passed and these SOBs still have not processed my case. I have never been out of status in the 16 years I have lived in the USA and have never been in any sort of trouble.

Senator Feinstein’s aide has left numerous requests with USCIS HQ and has received no replies.

So.... over 2,000 days after filing my I-485 I am still stuck in limbo and to make things worse I am a virtual prisoner here because my travel authorization has been denied.

I realize that my case I rather unusual (maybe even unique). I am so very tempted to submit a WOM - the only concern I have is that if the judge orders USCIS to make a decision then USCIS may just deny my case citing the fact that they have not completed whatever it is that is holding up my case.

Any words of advice regarding WOM would be appreciated.

In my opininon, you should have filed WOM a long long time ago.Collect all the proof (letters and responses from the senator's office, infopasses etc) and sue them. If you have no negative information (bad records, criminal hostory etc.), you have nothing to fear about. Document every peice of evidence and sue them. You have a very big advantage in that FBI has already said that they have cleared your name check.Check out the thread http://www.immigrationportal.com/showthread.php?t=194681 if you have not already done so. You will get access to every information that you will need to know and more. There are tons of people who have done this and will help you out.

In my case, I wrote to senator that my daughter is turning 21 within few months and since I am primary and she is dependent, she cannot get her green card before turning 21...
other reasons: she can not get any sholarships due to being NOT GC holder (so not permanent resident) and NOT an international student, even though she is a very good student..
well other weak reasons are usual like need to apply every year for travel docs and work permit..need to travel on business such as scientific conferences...
I think my daughter's 21 age helped, although she was (as I think) protected by some 'child act'...
