Name check before issuing Interview letter from 2007?

Name check to be cleared before issuing Interview letter from 2007?

A friend of mine mentioned that beginning January 3, 2007 interview letters are issued to only those who name check is cleared. I am not sure how credible this information is??. It seems this is due to the large number of cases filed against USCIS related to name checks.

I could not find anyone from this forum who recieved interview letter after January 3, 2007 and stuck in name check. Is this coincidental?

I could not find any information...

I tried hard searching USCIS website, Googled etc and could not find a source that validates what my friend has said. He came to know the information through his lawyer. I asked him to find the source from his lawyer. Does anyone know whether this is true?

"The established system of records will be effective January 3, 2007 unless comments are received that result in a contrary determination"

" This new system of records is called the Background Check Service (BCS). USCIS conducts three different background checks on applicants/petitioners applying for USCIS benefits: (1) A Federal Bureau of Investigation (FBI) Fingerprint Check, (2) a FBI Name Check, and (3) a Customs and Border Protection (CBP) Treasury Enforcement Communication System/ Interagency Border Inspection System (TECS/IBIS) Name Check. BCS will maintain the requests and results of all background check activity for USCIS. "

"The results of these background checks will be used to make eligibility determinations, which will result in the approval or denial of a benefit. "
 
I've heard cases of people who've had interviews in 2007, and yet at the end were told they couldn't be approved due to name check.

Have you seen any one received their Interview Letter after January 3 and got stuck in Name check? Based on my friend's account, this new process is in place for people who received interview letter after January 3. So for people who received interview letter before January 3 and had interviews after January 3, 2007 this does not apply according to him.
 
Not ture. Got interview letter on 1/3/2007 and interviewed on 2/21/2007. Got the name check pending result.

Also, since we are just in the beginning of the year, there is not substantial amount of data.

My notice date was 1/3/2007, got the physical letter on 1/9/2007. So the lawyer's statement is not correct.

What does this mean?
Does this mean that the Name Checks will no longer be done by FBI but instead will be done by USCIS themselver?

Personally I think the fact that your letter is dated Jan 3rd means that you might be on the border of when they changed over. If your letter was dated Jan 4th I'd be more convinced.
 
Name check is being cleared before interview

My lawyer just told me that interviews are being scheduled only after the name check is cleared for both GC and citizenship cases. So what your friend suggested may truly be the case.
 
Interview Letter dated Feb 20th

I got an interview notice dated Feb 20th for an interview scheduled in April. Hopefully this means I made it through the name check already! Fingers crossed...

no date yet

Filed in October and RFE received in Nov.still no interview letter :mad: , dont know if that's the normal procedure, im getting impatient now. DO is Baltimore.
