Hi there,

My wife passed her naturalization interview today in Garden City, NY. She was asked about 10 questions related to history and politics of US. Here is the application timeline:

N400 applied: May 13,2007
Receipt Date: May 17, 2007
Fingerprint: June 14,2007
Interview Notice: November 30,2007
Interview Date: January 17, 2008
Scheduled Oath ceremony: January 31, 2008

Unfortunately, her name on the notice for oath does not match either her GC (premarital name) or her new married legal name. USCIS said nothing can be done about it now and we will have to wait till the oath ceremony after which name-change affidavit will have to be made in court. I am not sure about the process. Any advice will be appreciated.
Can she get the passport with the new name based on marriage certificate, SS card, DL etc?

Thanks

Ritesh

Did you take infopass and talk to office and explain them this? Till you receive nat cert in hand, it is possible for them to make changes (If they wish)

In most cases (Atleast in Atlanta DO) they go only by birth certificate and only allow last name change due to marriage. Anything else, you have to choose Judicial oath ceremony.

Your wife would have known the name that will appear on the certificate since she has to write that name on the photo herself. Did she not notice the wrong name while writing it on the photo? The name that appears in the oath notice is same as what she wrote herself on the photos? If the name she wrote on the photo is same as what appears on the oath letter, then it is kinda hard to argue now.

Changing name in local district courts is not that hard. You need to find which court in your state handles that In Atlanta, it is a Superior court. Go to
http://www.courts.state.ny.us/forms/namechange.shtml and you will get some information. Another link is http://www.namechangelaw.com/states/ny/newyork.htm

It is not that hard and you do not need a lawyer (Though if you hire one, they do it all for you) Basically, fill 3-4 forms. go to court and submit them with fees, they give you a court date, go there infront of judge and tell why name change, he signs the order.

You will get passport with exact name that is on nat cert (Unless you provide name change order, then you can get it with what is in name change order) Name in your GC/passport/driver license has no bearing on passport name.
Hope that helps

Ritesh,
Just a quick question. Did your wife receive the oath date after she passed the exam or did the letter come by mail?

What exactly happened here? Did she request a name change on the N400 form and they ignored or mishandled the request? Or did she fill out the form without requesting a name change, and they messed up and put the wrong name on the notice? If her name change was before applying for citizenship, did she ever get a court order for the name change?
