Name change in H1B

Hi,

We(my husband and I) applied for a H1B and H4 respectively in Aug 2004. His H1B got approved and we noticed there was a typo in the surname(one letter) when we got the visa papers. This is the mistake of our company's lawyer who filed for us. All the supporting documentation we sent is perfect.

The INS(USCIS) made a mistake with 'Country of birth' as Australia as we hold Australian passports though our country of birth is India. But this is INS mistake.

However we went to the Embassy on advice of our company and they have asked us to get the country of birth corrected. We sent the papers back to the company for correction of both of the mistakes on Dec 1 2004. And we believe they have been sent to the INS but am not sure what the process is.

We have no news till now. Can someone please advise me of how long this might possibly take?
