***Name Change* I-485 Form

I have a friend that has a question concerning her I-485 form.

She was granted asylum about 2 yrs ago, and she is finally applying for the I-485. However, a year ago she changed her last name that is differnet from the one she applied for Asylum. She changed her name for personal reasons.

Now that she is applying for GC, what name should she put on the I-485 form? Her first name is the same, just the last name has changed. She is concerned that when she gets closer to GC status (5-10 years), the information she "may" provide such as W2's, Bills, etc., will be under her new last name, and not the asylum granted last name.

Is there a cause for concern, or should she just subit the court papers as well to show her name change? Please advice ASAP.

I think there is a place in the application where they ask for old or other names
 
Ok - here is what your friend must do:

1. First, she must have legally changed her name. That means having gotten a judge's order granting the name change. [The order usually lists old name along with the new name.]

2. She must have also changed her DL and SSN to match that of her new name.

3. When filing the I-485, she must use her new name as her current name, and then list her old name in the 'previously used names' section

4. She must attach a copy of the judge's decree granting her name change to her I-485 application

5. She must attach a copy of her DL (with the new name) to her I-485 application. This provides as additional proof that her name has been changed.

If all of this has been done, then she will be fine.

On another note, you do realize that she will need a new I-94 that reflects her new name. In addition to this, she will need to include a copy of the judge's order [granting the name change] to every single CIS application until she gets her GC.

Hire a Lawyer and go through with that!!..including evidence of name change. TELL HEr to put some money down on a lawyer..! Name change is BIG in this country even though some foreigners don't know that simply changing a letter in a last name makes a difference.

Funny story to tell..My dad's friend, not an asylee but he took off a O in his last name..and went to his bank..and said "well they sound the same"..the bank was like Well buddy thats not who the account is under..and locked his account..Till he went and LEGALLY changed it back..!..

Name change is a mess! go t hrough with a lawyer..
 
I don't see why she needs a lawyer,when she legally changed her name, and she has the court papers?

You’re right. She doesn’t need a lawyer for such a common procedure.
Just follow the LolaLi’s advice above and your friend should be fine.
