name change from maiden to married

I have filed my I-130/I-485/I-765. I noticed on the recept letter that my lawyer filled out my last name on the Petition for Alien Relative (I-130) as my US citizen husband's last name yet all the other forms with my maiden name as shown in my native passport. I do not have any legal ID with my married name, only maiden. Now my lawyer tells me I need to hurry and change my maiden name to my married name or USCIS will suspect us of marraige fraud and will review my case "under microscope". Is that true? What should I do?

Last time I tried to change my maiden name at the driver's license office, I was told I needed my Green Card or proof of Employment of Authorization. All I have is the letters called I-797c Notice of Action with Receipt Numbers stating that my next step is to have my biometrics taken.

First of all, do not worry. Once you get your EAD card with your new (married ) last name you can step by step change the name on all your other documents. When you go to your biometrics appointment make sure you take your marriage certificate with you along with your passport and driver's license.

my experience

I went to DMV with my marriage certificate and they changed my last name. Maybe you want to try again, difference officer treat people differently. But as the above person just said, once you have your EAD, you will not have any problem changing your name. Good luck.
 
Make a search over this forum, that situation has been explained before.
There is no need to change your maiden name to your marriage name for immigration pourposes is a personal decision. But you should be consistant.
The issue here is why your lawyer but two different last names in the forms, when it should be the same in all.
Your marriage certificate is the proof that why your old id's before you got married like your passport has your maiden name and not your married name which is totally understandable. The same in your driver's license, actually that depends on the State you are, some request that your Social Security number should get the change of name first before do it on your driver's license. Since you still even don't have an EAD, your only proof right now is your passport and your marriage certificate and the USCIS will know that you still are in the early stages of your process and you already get the interview.
Do you have a SSN? Since you say that you are in the part of biometrics...
