Name change and supporting documents

Hi everyone,

My USC fiance will change her last name into mine right after the wedding (actually, her new last name will be shown on the marriage certificate).

We're going to file USCIS forms with her new last name.
But ALL the supporting documents (tax returns, passport, letter of enrollment from school, certificate of naturalization) show her maiden name.

Is that a problem?

I believe when she fills the G-325A form she has to put also her maiden name, so I don't see any potential problem. Obviously she can't change her name on past tax returns or certificate of naturalization, but maybe USCIS would argue that we could have waited until she gets a new passport or changes her name in school (which she doesn't intend to do).

Anybody with experience in this?

not a problem for us

After my husband and I (USC) got married, I changed my name at social security, driver's license, bank accounts, passport, professional licenses, etc. But since I'm a little older (in my thirties) and we had been together for a few years before we got married, many of my documents (birth certificate, documents from our home purchase, past leases and bills, etc.) were in my maiden name. It was not an issue at all. I think that they mostly go by social security number anyway. Plus, your marriage certificate and papers from social security will show that both names are the same person.

Also, when your wife changes her name on her passport (before it expires), they just print a sentance saying that the name was changed on one of the last pages. The actual passport, including the first page with the picture, will be exactly the same. So it is also a good way to show that both names are the same person.

I'm not a lawyer, this was my experience.
 
There is no problem at all, I changed my last name as well and the rest of my papers were in my maiden name, but I did not have a ssn by that time anyway...so it was not big deal, but my passport is still with my maiden name I have to go back to my country to changed the name since I would have to go the my embassy to do what smc01 said, my consulate does not do that (or don't want to). The only thing is that if she is going to change her name then continue using the same name in ALL the forms, to avoid confusion.

Good luck, later on she will have the time to change the name in all the other documents.

She will change her name with SSA on the same day we get married in City Hall.
For everything else, there's plenty of time and really no necessity.
Plus, she doesn/t want to change her passport because she would lose all her stamps/visas on it (just found out that US passport agency doesn't amend passport anymore, but issues new ones because they're improved securitywise and they're trying to get the old ones back).
