Hello all,

Please I need assistance on how to proceed.
I filed N600k for my child following - children born outside the US seeking naturalization via US citizen parent but now one of the requirements indicates - child to be in legal and physical custody of US citizen parent but I currently reside in the US and my child resides outside the US . Is there a waiver for this because all docs have been reviewed awaiting approval for appointment date but that seems to be a clause however the requirements states child has to be in the US for interview which will not be a problem due to the fact that visa can be obtained before interview date .
Please , anyone and everyone , kindly advise
Is there exception aand or waiver .

It might be better to wait until a year or two before they are ready to move to the US, and petition them(i.e. file I-130) to immigrate. They will get immigrant visas, and when they enter the US, they will immediately become US permanent residents (green card holders). If at that point, they are under 18 and living in the US in the custody of a US citizen parent, they will immediately become a US citizen under INA 320, without needing to do anything extra.

The problem with going the INA 322 naturalization route with N-600K is that the child needs to enter the US as a nonimmigrant (usually as B2 visitor) to attend the interview and oath. But most nonimmigrant statuses, including visitor statuses, require you to show that the person does not intend to immigrate with the visa. There is a great risk that either the visa officer will deny the visa, or the immigration officer at entry will deny entry, if they see that the child plans to move to the US, especially since the child has a parent living in the US (since parents and children usually like to live together).

Hello! I have a similar situation. I applied for N 600K for my kids under 12 years old according to their grandfather's physical presence in the USA. I am wondering if there is an interview waiver. Can you provide me with update? Thank you in advance!
