I just wanted to share my experience and ask if anyone had similar experience or any suggestion to my current situation.
I am a newly naturalized US Citizen; I had an I130 petition pending for my wife, which I upgraded.
Since the I130 is upgraded to the Immediate Relative category; I was posed with a problem for my new born son (8 months old). I had to choose between applying a separate I130 for him and wait for another 6 or more months to process it or apply for an N600K.I spoke with the USCIS through their 1800 number; and got a processing time of just about 2 months for N600K.
I sent a completed N600K form to Milwaukee (my local district office, where I was naturalized) and they sent it back saying that I should apply I130 and that my son would have to be a permanent resident for me to apply for a certificate of citizenship. I sent the same application to Buffalo, NY; they accepted my application and cashed my check. However, they sent me a letter indicating that it would take between 6-9 months for them to process this type of application.
Now I am in deep trouble, my wife’s immigrant application is getting processed in NVC and would be shortly sent to the consulate in Montreal. She is on a student visa that would only have enough time to stay in Canada, up until her immigrant visa to the US is processed. She cannot stay another 6 to 9 months for my son’s N600K to be processed.
As my son is a Canadian citizen by birth, has a Canadian Passport, can he travel to the US along with wife when she gets her immigrant visa and wait for his interview date on N600K? Or should my wife go back to her home country; wait for my son’s interview date and then enter the US with her own immigrant visa packet?
Any help would be appreciated.
