N400 - Wrong issue date on my green card, application declined.

Hello everyone,

I just received a denial on my N-400 because the issue date on my green card is wrong, according to USCIS. On my green card i clearly see that it says "Resident since: 6/11/2006", however, in the USCIS system they have different date 6/11/2007. When i received the denial, i was extremely surprised and confused. They wrote on the denial notice that i have applied earlier than i am supposed to (including the 90 days early submission). According to USCIS i applied 20 days earlier. (My application was accepted on 2/20/2012).

Any thoughts what i should do now? I guess my options are: Appeal OR Re-apply, but wanted to see if anyone here experienced similar case and i'd appreciate to see which option will be faster.

You are not the first one in thsi respect. First thing is: when are your GC approved? If it is 6/11/2007, then
you can not do anything. The date of residence since does not count. You have to re-apply. Don't bother
about appeal.

Of course, I think you can sue USCIS for printing a wrong date on your GC

When did you actually get the green card approved? When did it physically arrive in your hand? A clerical error causing a wrong "Resident since" date to be printed on the card doesn't give you the right to apply based on that incorrect date.

Did you get an interview?

Are you an asylee? If yes, they would backdate the card by a year, in which case you might have grounds for appeal.

I received my A# in 2006, along with a travel document and work authorization. The physical card arrived in 2007. I am planning to do an appeal. Does it make sense to do an appeal and apply again? I read that an appeal interview might take up to 180 days.

* I had my interview and the IO did not tell me that there was an issue with my GC :( He said all is good, recommended for approval.

It arrived in June 2007 or later? Then the denial was correct and you will lose the appeal, unless you have some other evidence (other than the card itself) that the approval actually happened in 2006 or early enough in 2007 to make you eligible to apply in Feb 2012. Or you're an asylee eligible for backdating of one year.

Because at the time of the interview, the IO didn't realize the date on the card was wrong. Then on further investigation, the mistake on the card was noticed.
 
Going by 06/11/2007 you were indeed 20 days early in applying. Even if it were honest mistake. Just reapply.

If they did not complain to you that ur GC wasn't good, I see no reason why you need a new one. At the most get an info Pass meeting and find out.

Sadly, you may need to pay new filing fees for your N400.
