I am preparing to file my n400 for naturalization, as I had trips abroad I am to produce tax information (transcript/copy of returns) for the period i had been abroad as evidence of maintaining ties with America and non abandonment of residency. I am to apply by the first week of February, If i am required to produce last 5 years transcripts is it for the years

[A] 2009,08,07,06,05 ?

or

2008,07,06,05,04

I have not filed my taxes as of now, normally i do it right before April Th.is there going to be an issue ? I am sure I will have the taxes filed and the documentation before the interview, but I have not received my employers statements, and I do not want to delay my n400.

Please advise

If you apply before Apr 15, 10, 2008 to 2004 Tax returns are sufficient.

No need or requirement to expedite filing early.

pls keep in mind that tax returns and transcripts can NOT be single evidence to support residency requirements. In fact, you could have lived overseas and just filed taxes in US. You will be expected to produce more documentation if you broke residency rules. Examples: property lease or ownership, utility bills, car registration documents (if own own a car), state ID, etc

I was a full time student at my native country when i got my gc in 2003, so i came to America stayed a month and returned,
in 2004 came to America again got a REP stayed 3 months and returned to my native, and i returned on ND of February of 2006, as with the 4 year + 1 day rule i am eligible by the 3rd of Feb 2010. M476 explains the 4year+1 day rule with an example and i can relate to that example. I am needed to show that i hadnt abandoned my reidency for the time period mentioned above with my N400. earlier to 2006 i was a full time student in india, so my dad was claiming me as a dependant, i have access to his tax returns and have copies of it, i was planning to send in the copies of his tax returns for 2004&2005 and mine which i filed individulay for years 2006, 07, and 08. As i was a full time student in my native country prior to 2006 ,I have no utilities, no lease,no mortgage, i dont think i have a state ID ( i might have had a Driver's lisence taken at that time, but the DL i currently have shows"issued in 08 and that it expires in 2016"), i didnt have a bank account, nor did i have credit cards, or a car registration, or any insurence at that time.My dad, sis and family resided in america while i was away, but when u say that immediate relatives stayed in america doesnt it normally imply about the individuals wife and kids? what can i use that will help me ?

Is my interview heading for a defenite denial? should i just wait till its november (5 years -90 days) ? rather than to keeep my hopes up and be crushed at the interview? i was so looking forward to filing visa petition for my newly wed wife . :( nd her arrival depends on my naturalization so much :(

They tend to be lenient towards students, so I think you'll be OK if you have papers to show that you were a student in 2005-2006 and dependent on parents who lived in the US. Go ahead and apply in Feb. and see what happens. If denied, you can just reapply in November and the denial won't be counted against you (it's not like a denial for lying or bad moral character, which often would require you to wait years to reapply).

My convocation was on the 16th of February '06 (the ceramony/walk) thats the date on my degree certificate. I arrrived in America on the 2nd of Feb '06. I didnt wait for the ceramony. I shall take all my marks cards and the degree certificate for the interview.

Thanks Jack
