N400- question: Foreign Passport with married name and GC with maiden name

We had to get my wife's passport changed to my last name due to certain complicated (and funny) reason...

Now the situation is that her GC, SSN, Bank, DL etc have her maiden name but her Indian passport has my last name. the Indian passport does mention the maiden name on the last page (under maiden name section and if I remember correctly, mentions husband's name as well) and also has old expired Indian passport attached with it, which mentions maiden name.

My questions is:
1. Can we apply for N-400 with name change option for my wife (due to marriage)?
We will be filing from either San Jose or San Francisco. (I have read somewhere that SJ/SFO do not allow name change. Is it applicable for name change due to marriage as well?)

2. Does name change delay the process in any way?

Thank you for your valuable input!

1. Yes, you should be able to apply for name change for your wife, due to marriage. I don't know of any other circumstance where it is or isn't allowed.

2. Yes. It does affect processing time. I think someone in SJ did it recently; browse the thread for more info.

I believe you can change your name for any reason. E.g, I could have changed my last name if I wanted.

My wife did use the name change option to change her last name to be the same as mine. Up until then, she was using a combination of her maiden name and her maiden name and my last name.

Her oath was 6 weeks after mine, but I don't know if the name change was the cause for the delay. In all, her process took 6.5 months from N400 being mailed to oath, so it was still pretty quick. We had mailed our applications in the middle of June 2007, before the fee increase rush.

Thank you Derekleewo!

Did you file from San Jose or San Francisco? I heard earlier that SJ/SFO do not accept name change "except due to marriage" and wanted to confirm if this is really true and if name change due to marriage is positively accepted by either DO.

Thanks again!
