N400 - ever failed to file a tax return?

I won't bore anyone with the whys but I failed to file my tax return for tax year 2006. I applied for the extension but also missed this deadline. I did finally file 2006 in January 2008, about 3 months after the deadline expired. (Oct. 2007).

The IRS accepted my return and I do not owe them any money, and all other years are filed on time.

Do I need to state "yes" to the question.....have you ever failed to file a tax return? And if so, do I also need to include a written explanation with my N400 application?

Some lawyers say the questions ask "have you ever failed to file tax return"
not "have you ever failed to file tax return on time". So the anwer is NO.

Many people do not have perfect local tax records but do not care care about that question and just answer NO
 
You did finally file your tax return in 2008. So the answer should be "No".

If you didn't file at all, then you would have to answer yes.
