N400- Applying in Wisconsin

Hello friends,

I am planning to apply for my citizenship in May 2005. I have the following questions.

1. Along with form N-400 what documents should I include?
2. In the last 4 yeras and 7 months I have got one speeding ticket. Does this create any problem?
3. I have not gone out of US in the last 5 years. After mailing the application and before becoming a US citizen, can I visit India?
4. I have decided to move back to India after becoming US Citizen. Is there anything I should know before applying to citizenship?
5. Do I have to surrender my Indian passport at the time of becoming a US Citizen? Do I need to have Indian visa once I got the US passport?
6. I have a daughter who is 7 years old and she is a US citizen. She has been taken to India by her mother and I have not seen her since last 5 years. I have the primary custody of my daughter and the custody order from US court is not valid in India. This is the reason I am planning to go back to India and try to find my daughter. Do I have to mention any of this in my application or during interview?

1. Application fee + FP fee, and copy of GC (front and back)
2. No. But you should disclose this on your application.
3. Yes. Preferably after you are fngerprinted, make sure you don't stay out of the US for more than 6 months. However, you might get your interview sooner in Wisconsin.
4. You can, you dont have to do anything.
5. No, you have to with the Indian consulate. You could do that when you apply for indian visa / dual citizenship.
6. Since you have primary custody nothing to worry about. If you do NOT have primary custody and did NOT pay child support, then there would be a problem.

Are you sure custody order is not valid in India? You should have filed a kidnapping charge against your wife and that would have made your case stronger when you 'fight it' out in court.

I would like to add something to the last point as Phillydude has summed it up very nicely.

Although you do not have to mention details of your child, ex spouse, you have to fill out the information pertaining to ex spouse. This is section 8 E.
You will have to provide detail of your daughter in section 9.

Outside the naturalization process here is my suggestion:
- Talk with your divorce attorney regarding Geneva convention/law where divorce related matter settled in USA, is recognized in India.
- You may also check with your local county office to discuss this matter.
- Your spouse could be served papers to bring your child to US/US court. Even though she is in India, I believe papers could still be served by a process server.
- Based on what you have written, the US law is on your side to let you do the best for your daughter. You may want to report this matter to the authorities to form the basis of your future case.
- If you intend to fight for your daughter in India, be patient. The system awfully sucks in India due to the delays. It may tax your sanity too.
- Since it has been 5 years since you daughter has been away from you, you may have to provide a reason for this time period. Anyway, you should meet with an attorney who has knowledge about international laws + family laws.

Thanks for taking your time and responding to my questions. Regarding my daughter here is the information.

I have contacted FBI and gave my daughter's information. Currently she is listed as missing in National center for Missing and Exploited children web site. There is no Gineva convention between India and US (really sucks). I have explored all possibile alternatives.

I know it will take years to battle in Indian court. I have been preparing mentally for the last several years. Thanks again for your kind response.
