N400 application filed in October 2003

It has been three years since I filed for citezenship. I was interviewd in Feb. 2004 and at the end of the interview, I was told that they are doing background checks and that I will hear from them soon. Since then, I make an IPass appointment about every six months and am told the same thing: they are waiting for more information.

Has anyone else here been through a similar expereince? What should I do besides just waiting around as I have been for the past 2 1/2 yrs since my interview?

Any help would be greatly appreciated.

You are way over due to file a lawsuit. You should file it ASAP.
 
I agree,

As Shaffi said, you need to file a law suit. Check out the thread on the lawsuit. The law says if USCIS cannot give an answer back within 120 days after the interview, then you can file 1447(b) lawsuit against USCIS. Kindly check that thread, it has more and accurate info than what I can provide.

I consulted an immigration attorney and he said that the potential downside to filing a law suit could be that they just deny the application. I do not know if this is true. It does not make sense but obviously it concerns me.

It seems like I have been patient enough and its time to do something about this delay.

Well,

I read somewhere on this forum under "Citizenship" that this person sued USCIS after waiting couple of years after the interview. USCIS attorney apparantely countered that if this was important, the person should have acted within reasonable time, hence, claimed that the applicant lost his/her right to sue. I don't know what happened after.

You should go through the threads in the "Citizenship" section. It may take you few hours to scan through, but at least you'll get better grip on this type of situation.
