I had an interview in Oakland CA on 8/12/2002 and the officer asked my school transcripts. I gave the transcripts next day and am still waiting their decision :-( I called Laguna INS office and visited San francisco INS office although answer was same

" Your file waiting for supervisor's decision "

I am waiting for the decision since 8/13/2002

How long should I wait for the decision ? How can solve the problem ?

Thanks in advance

Could you share why you were asked for your school transcripts? Seems like an unusual request.

Actually I got my green card during the 1995 then I returned to my native country to get my master degree. However, I come back to the US on September 15 1997 with re-entry permit.

In this case, 4 years and one day is enough for citizenship so I applied after 4 years and three months, which is November 2001.

During the naturalization interview the officer asked my school transcript for school years 1995-1996 :-( The officer suppose to ask anything between 1997 to present not before.

I have no idea " why the officer asked me those transcripts for yera 1995 and 1996 "

However, I did not need to hide anything and gave all my school transcript.

Waiting is the most horrible thing.

Any advice ????

Hi Akinar...

I applied for naturalization under the exact same condition as you did. I got my GC in 1996 and then had to return to my native coutry to complete my undergrad studies. I got back here in 1998 on a reentry permit and applied for citizenship in june, 2002, after 4 years.

PD: June 6, 2002
FD - July 17, 2002

Waiting for the interview.

Can you share your interview experience for this particular scenario? Any help would be appreciated. Other than the transcripts, what additional documents did they ask for?

As far as your wait for response is concerned, I guess it is because of the general freeze they put on due to the additional background check.

Thanks

I would go back to the Oakland INS office and ask them the status of your case. I think they are pretty helpful in letting you know. I would go as early as possible in the morning (like 7:30 AM or so) when there is not much rush. Just make sure you take your GC and the last communication with INS.

Good Luck.

Akinar & Abhp123 ,
I did a similar thing like you guys- got GC in 1996 and went back to US on a Re-Entry permit , came back in 1998 for just a month, again 2 year Re-entry permit , and then since Oct 2000, iam living here continuosly.
I had a couple of questions to ask you, hope you find time to answer them.

1. As you guys mentioned in my case, the 4 years and 1 day rule should apply. Just for confirmation, Abhp123 How long had you lived in US betwen the time u got ur GC in 1996 and leaving US on Re-enrty permit? In my case i just lived for a month or so before i left US after getting GC. But since Oct 2000 it has been continous residence.

2. Did you guys submit the tax returns for the years that you were outside of USA? I heard that it is required, so would like to confirm with you guys as you have been through this process personally.

And by the way, Akinar, i fortunately read ur post especially regarding the Transcripts. I did my undergrad during the period that i was oustide US on RE-Entry permit. So i may be needed to produce the same.
I wish you both Good Luck, and wish that you get Citizenship soon.
Thanks.

rhegde,

I was here for a little less than 2 months after getting my green card. I had to return to my native place to finish off my undergrad. According to the lawyers, given my situation I am eligible to apply after 4 yrs and 1 day.

As far as tax returns go, since I wasn't earning anything during that period, I did not have to file taxes. So I did not send any papers for tax returns either.

abhp123,
Thanks for responding to my question. I think i too can apply after 4 years and 1 months since Oct 2000.
Regarding Tax returns, i am hearing people on different forums saying that it is needed even if you do not have income. So just to be on the safer side, i may file return to claim no income for the years i was outside US. At this moment iam not sure how to do that or whether i can do that.

Thanks.
