N-470 - What is Neeeded for Approval?

Hi,

My employer is likely to ask me to work in India for an extended period of time. This is an American company expanding operations in India. I will be on the Indian payroll of the company and I will be paid in rupees, the local Indian currency. Will I have any problems with the N-470 approval because of this?

Also, how long does it take to have an N-470 approved? I would prefer that my N-470 be filed and approved before I take up this assignment.

Has anyone on this forum done this before and would you recommend employing an attorney to file the N-470?

Boatbod - thanks for taking the time to respond. This is useful information for me. My company fits that criterion but I've never been in the US continuously for 1 year in the past decade or so. Is the USCIS that stringent about this requirement? Or is there a provision/alternative or does the USCIS make an exception in some cases?

My understanding is that you must have met the uninterrupted residence requirement at least once between obtaining your GC and when you apply for N-470. Enforcement of this requirement will be based on the requirement to submit copies of all your passports that you've used since becoming an LPR.

From the N400 Instructions:
In addition, you must submit the following evidence.
1. Attach a copy showing the front and back of your I-551,Permanent Resident Card.
2. Copies of legal evidence of a name change or date of birth(See Part 3 of the form).
3. A complete copy of all passports in your possession,expired or unexpired, issued to you since your admission as a permanent resident to the United States.​
