N-400 related questions

Hello forum members,

1. I am currently divorced and applying for citizenship through 5 yr LPR - 90 days rule on May 2007. Mine is an employment based green card. I am going to get re-married and my fiancee is not in US currently but will be coming on May 2007. Is it advisable to marry after getting my citizenship (which will be after Aug 2007 if all goes well)? Or, can I marry her before I send my N-400 appln to service center on May 2007 and include her in my N-400 Application and answer the marriage question as Married, OR will there be any issue if I marry her after sending the N-400 Application and before getting to the Interview stage/getting Citizenship?

2. I came to US on a F-1(Student) Visa in 1997, but discontinued my studies after changing to one more university and then got a H1-B. Will there be a question during Citizenship Interview regarding this or any other stage? If this arises as to why you quit your studies in the middle, how should I answer in the right way?

3. I see that Nebraska Service Center has the following address in USCIS website which has a PO Box. When I called FEDEX, they said that they don't deliver to PO Boxes. How do I send through FEDEX or other private delivery services which is more reliable? Do I need something like signature confirmation/proof of receipt etc from FEDEX? The reason why I am asking is, in the past my mails got lost with USPS mail deliveries. Is there an alternate address to NSC for sending N-400 applications apart from the one given below?

I am NOT a lawyer but here is what I would do:

1. Which visa is your fiance coming to US on? There is no benefit of mentioning your fiance on N400. If your fiance has a valid US visa then no issue in when you get married. If not, become a citizen, get married and then file her I-130 & do counsulate processing. If she has a US visa, then become a citizen, get her in country and marry her and then file I-130 and I485.
2. Non issue. They check your last 5 yrs background since you became LPR. so don't sweat.
3. Use USPS with delivery confiration.

Item#2 - your full immigration history is fair game to USCIS during the N-400 process, so make sure you can answer whatever questions arise. Hopefully you never went out of status during the transition from F-1 to H1B? Assuming you didn't, I don't see any issue. Just make sure you tell the truth if asked why you changed universities etc.

Note: the "right way" to answer the IO's questions is truthfully, but that doesn't mean you should let your mouth run away and volunteer a whole bunch of unsolicited information.

Thanks for your response. She is coming on a H1B Visa which she already got few months back.

Since she will have her own H1B, it doesn't much matter when you marry her. As her spouse, you can sponsor her for I-130 anytime, but as an LPR, the process will take longer than if you were a USC. Once you take your oath you can write to USCIS and have your I-130 petition upgraded, along with submitting an I-485.

Thanks for your response. No, I was not in out of status at any time during the transition from F-1 to H1B or during any other time in my entire stay in US. Got what you were trying to say.

Item # 1. It does not matter when you marry. You can marry before or after sending N-400. If you marry before sending N-400 then mention the marriage on the N-400. If you marry after sending the N-400 then mention your marriage during your Citizenship interview. So it does not matter when you marry. Just make sure that if were married before you have legally divorced before getting married again. Have court divorce papers ready in that case. Also have court marriage dolcuments for your marriage.

Item # 2. The question may arise as to why you quit your studies. Tell the truth. You got a Job and felt you could not pass up the opportunity. This really is the best answer. Follow boatbod's advice in this case.

Item # 3. I always send communication to USCIS via Express Mail (US Postal Service). This is next day service. It costs $14.40 plus $1.85 for return receipt for a total of $16.25. This is very safe and reilable.
There are issues with FedEX etc. about delivering to PO numbers.
