N-400 Question #21 part 10 HELP!

hi.. my father was arrested by the Nicaraguan Sandinista group for political reasons.. in 1984 .. & when he arrived to the states in 1988 he applied for political asylium... & filed an I-589 form & indicated that he had been arrested


Now, on the N-400 (Part 10 # 21 ) asks, [ have you ever been in jail or prison ? ] my dad wants to know what he needs to answer.. considering that he was in jail back in Nicaragua & not U.S.A


if yes what document must he show when mailing the form ? you help is needed

Well since USCIS already knows about his arrest in Nicaragua, I would think he probably needs to declare it on the N-400. Answer yes, include an explanation and I'm sure the IO will make a note of it during the interview.

so in other words as long as he notes ( yes ).. & presents the proper documentation on the interview...its ok ?

With INS if you cannot obtain proof of original document.All you need is Noterised affidavite.

I would say yes, but remember I'm not a lawyer...
