N-400: Need help with Employment Dates

Friends, I have a doubt about my employment history.

From March 2006 - November 2006 I worked at a client site through friend's company A, but never had any pay. In November 2006 I formed a company B and got all of that pay on a Corp-to-Corp to my company and raised a payroll.

Now my question is, what to write in the employment history for that period. Do I write I was employed through company A? I feel that I should not write that. If I write company B, that could raise eyebrows because the company was formed in November 2006 and I feel I should not put that either.

You need to write the company that made your payroll, which is company B.

What's the problem with being unemployed for 6 months? Nothing. So company B forming in November 2006 has nothing to do with your case.

However, your story of not getting paid for working from March 2006 through November 2006 does not sound straight. Is there anything you would like to add? It is likely that the IO will ask the same question if he/she digs into this area.
 
The company issued you W2 -if any is the one to report.

If not paid, being owner....i would add "COMPANY B (owner of the business). Just have a copy of Corp Tax return for Company B with you.

January 2003 - Augugst 2005 Employed by company A at various clients.
August 2005 - February 2005 Employed at company C
March 2006 - June 2007 I was at client site got paid $X/hr and it went to company A. (There was no payroll during this time)
November 2006 Formed my own company B and got all the money which is earned from March 2006 as corp-to-corp . I ran a payroll from company B for all of my earning at one shot at the end of 2006.

I hope I am clear about what happened.

I think as DreamUSA said, I may have to show Corporate Tax returns.

That money was paid you from company A, right? So in effect, company A paid you for the work done from March 2006-June 2007. And you presented yourself to the client as an employee or subcontractor of company A. So write company A as your employer for that time frame. Or self-employed.

DO NOT get your corporate tax return involved with USCIS. It is not relevant as your corporation is a free-standing entity (which, according to the recent ruling of the Supreme court also has a right to free speech and freedom of expression - can the corporate right to vote be far away - one can make a taxation without representation case.. but I digress...).

Also, Company B (Owner of the business) is incorrect. If you really want to show that you run the corporation then put in "Company B, a closely held Corporation". Again, I don't feel that is required as you don't get any extra points for running a business. What happens if Company B gets audited by the IRS before the Oath? Keep your Corporation at an arms length at all times.

Here is the real situation:
Between March 2006 and Nov 2006, you were self-employed. It is besides the point that you earned no income during this time.

While this is not relevant to your citizenship application, you should talk to a CPA about this as what you did will cause you problems in an IRS audit. You should have paid self-employment taxes for the March-Nov income.

Thanks to all of you. Your valuable input really eased my worry about applying citizenship. I did pay the taxes at the end of the year for all of the pay. The only difference was, it came through my own company B rather than Company A.
