N-400 Filing Suggestions

Hi Memebrs,

I am 22 year old. I got my GC in 2004 Dec through my Father (employment based). I was eligible to apply for N400 in Sept 2009. But in Sep 2009, I started 2 year Full time Masters program in Europe and I am currently enrolled as full time student for program that will last till 2011. I am back in US for 2 weeks winter break and is trying to look for possible options to file N-400. I want to apply for N-400 in this time when I am here. Here is my position/thinking on how to procede:

1. My current trip (Sept 2009-Dec 2009) was second lasting 85 days. Before that I had made only one trip of 45 days in 2006 out of US since Dec 2004. So I think I am fine if I apply next week as far as continuous residance rule is concerned.
2. If I leave immediately after applying, would it be a problem?
3. I would probably get FP notice in next 2 months. I will be having my school closed for one week Easter break in April so I can plan coming back and do finger printing at that time. Would it be a problem?
4. I would be having summer braek for about 75 days in July - Sep 09. If after getting FP in April, I get IL for interview in May/June and I am out of country, would it be possible for me to send a letter to USCIS requesting to reschedule interview in July. Would they take such requests or it may complicate the matter.
5. Based on what I have found that my DO does not have same day oath and DO does oath only once a month and that too in 3rd/4th week of Month. If I get interviewed only in July then only I hope to complete Oath in August and get US PP quickly before leaving for Europe in Sept. My schedule is so tight that I have to start next semester in 3rd week of Sept. What are chances to reschedule your interview to a particular time frame by requesting USCIS. Has any one done it in the past?
6. Problem may come if I get rescheduled interview date of Aug/Sep then I won't get time to take Oath. Not sure how I can reschedule the Oath.
7. With me taking back to back trips, would it be a problem at the time of interview justifying IO about my continuous residancy.
8. I am living with my parents and they are supporting me for most of my needs, so I would not be having any house rent/utility bills to justify. I had some nominal income for last 3 years and I have filed a separate return for that and I am planning to get those copies from IRS. Are they good enough to justify continous residancy status. Other than that I have Bank account & my CC bills in my name. Also I have study loan from US lenders for my current education program. Do you think these documents are good enough.

What is advise of experts on the approach. Do you think it will go through without much hassles or you forsee many road blocks. Another option for me is to wait till 2011 after I complete my studies. But then in 2011, I would be out of coutry for almost over 500 days in last 2 years. I am hoping each tour would last between 90 to 180 days. If I have to wait till 2011, do you think I can apply immediately after coming back or wait for few months and then apply.

Hurry up and apply now and see what happens. The more of those back to back trips that you accumulate, the harder it will be to get approved.
What are chances to reschedule your interview to a particular time frame by requesting USCIS.
Zero. When they reschedule, they just set a future date based on what is convenient to them, and will ignore requests for specific date ranges. So you need to be prepared to fly back for the interview on short notice to avoid their unpredictable rescheduling.

But once you attend the interview, they are a bit more flexible about scheduling the oath date (e.g. if you interview in August, you might be able to get them to give you an oath in December instead of September).

Yours is a gray-area case, and we cannot predict whether you will be approved or not. You just have to apply and see what happens. If denied, you can ask them when you are eligible to reapply. But generally it creates a better impression if you apply after waiting at least 6-12 months since the end of a long trip or series of trips, than if you apply immediately after the extensive traveling.

Thanks Jack for useful advise. Please let me know the steps I would have to follow to request for change of Interview dates. Is it possible for me to send signed letter to my parents and they mail it to USCIS from US with return receipt service?

Would be very helpful if others can provide suggestions/advise. Thanks.
