N-400 Application

95 days!!!!! Nooooooooo! It should be 85 days or so before the 3 year mark (3 years - 85 days). The closer to the 3 year mark, the better. If you apply 95 days before 3 years be assured that your application will be rejected and you will forfeit your fee as well.

I was just reading another post about interview time. Someone said if a person filed N400 before reaching Green card 5th anniversary, the interview has to be rescheduled until the 5th year has reached. Is this also true for the 3 year case? I am going to file N400 before reaching the 3 year mark. (Please see my previous post).

If the application is based on marriage to a US citizen the time line is 3 years. Otherwise it is 5 years if it is based on presence in the US. There is a very informative document on USCIS web site explaining all this in detail.

The final oath can generally only be taken once the 3 (or 5) year mark respectively has been reached although based on current processing times you are most likely to cross the 3 year mark before the oath is scheduled.

Note that "marriage to a US citizen" based cases are scrutinized more closely than 5 year cases. In your case especially since you have only been married a little over 3 years and applying just around your eligibility term, you should be thoroughly prepared during the interview with all documentation/questions to establish your marriage. It is always advisable to take your spouse along. I read somewhere on the forum in at least a couple of cases where they actually interviewed the spouse separately in a different room to verify the marriage claim and then delayed the case due to potentially conflicting answers. Of course I always believe that if it is a genuine case one shouldn't really worry.

Was your green card application marriage based or was it employment based because if is was employment based; it always makes a case stronger IMHO.

Note that these are just my opinion. I am not a lawyer.

But we will still pay extra attention on all the document and questions about our marriage. My husband will also come to the interview with me no doubt; and we will prepare everything together (since that's how we prepared to apply GC).
I guess if for some reason my file is rejected; I am still a LPR.

When were you issued your conditional greencard? I mean the date of approval and one that appears in your GC? Since your marriage was on 7/03/06 and I wondering when you were issued your GC...:) The filing for N400 is based on 3 year marriage to the same USC spouse, but also a holder of the GC for 2yrs and 9 months. I just wanto make sure you aren't filing primarily on your marriage to the USC without the GC requirement having fulfilled. It is possible I ate too much salad for lunch and I am confused...:confused:

You are on solid ground because it seems as if your GC process was done in less than 6 months, hence you were a residence since Nov 06. Your timeline is in line with your eligibility date. This is my calculation of your eligibility window... I wish you best wishes young lady....:):) What is your DO?

DO means a District Office which you will be appearing for the intial interview and oath ceremony-though in some states, oath is held at the courthouse. I need to visit Portland...:) Again, be prepared for this final journey to be newly minted a USC...:)
 
While I am typing up my N400, I just realized that I left school on August 19, 2006 and I was not looking for a job until I received my GC on Nov 29, 2006 (just stayed at home) and then I went back to my hometown from Jan 30, 07 to Feb 23, 07 (24 days). Will an IO ask me why there is a gap from the day I left school until I got a job on Mar 23, 07? Of course I will tell the IO the true story, but will this affect my case?

A side question, my husband is 9 years older than me (he is 39) and my friend said this may be a factor that USCIS may delay my case. Is it possibile?

No need to worry about the travel. It is unAmerican to travel anyway for local natives...:eek: You are not required to be employed all the time, have you been to your local Social Security Office lately? There lot of freeloaders there, so you are fine. Don't worry about this and it won't even come up.;)

You husband age difference would have been an issue at the GC stage, but since they believe that you guys married for love, warm sheets and neighborhood walk, they approved you guys. Tell your friend to take it easy on maryjuawanna in Portland, he or she is misguided and you are going to have a smooth sail to your naturalization. If yout taxes are in order, no violations of anything, then you are fine. :D USCIS can't hold it against you that you long for your husband and he longs for you at night...:)

USCIS is interested in cases which raises red flags, you owe taxes and have no extension or payment plan with IRS. You are a drunk and committed crimes but if you kill a person, then you are out of luck for naturalization. However, you can kill flies all day and still be a good moral person...:eek:
