N-400 Application Returned

I sent my N-400 application sometimes last week and got it back today stating that i was not eligible because i do not satisfy the 5 years continuos residency. "You may submit you N-400 application, supporting documents and apprropriate fee to this service no more than 3 Months prior to meeting the applicable continuous residence under section......"

My Green Card approval date was 11/20/2001 and i mailed my application on 8/19/2006. I believe i qualify based on the 5 years- less 90 days rules.

The reason i think it was returned was that i signed the application on 08/19/2006 and it was returned because of the one day difference despite the fact that it reached them on 08/21/06. I plan to resubmit the application on Monday 08/28/06.

I'll appreciate your input on this.

My Residency dates are as follows:
GC received : 11/20/2001
OUT of the US about 6 times -Total- 484 days - All trips less than 6 months
I have been physically present in the US for more than 40 months.

I'll greatly appreciate your opinion if i should resubmit on monday or contact USCIS directly.
 
I have no idea why you cut your mailing date so close to the 4 yr , 9 month timeline...You should have mailed it 8.21 or after...now you have to mail again with new filled form and signature and all that good stuff..
 
Do the math and count days

Your belief is not backed by even 1st grade math. If you count the days, you will notice that you complete 5 years on 11/20/2006 and if you subtract 90 days from that day, you are eligible to apply for N-400 on 8/22/06.

Thanks very much i assumed my 90 days will be 08/20. I guess i was too eager to get this over with. :D

I hope they returned your check uncashed, otherwise its going to be an expensive math lesson :eek:

Well, you can re-apply now since now you are very much eligible. The good thing is that CIS returned your form immediately as opposed to finding the fault at the time of interview. The interview officer asked the applicant to withdraw the application or else it would be rejected. The bad part was that in the process, more than 3 months were lost. But you are in a much better position.

Can someone help?

I am little confused on when my husband will be eligible to apply. He received his green card on 1/18/2001. So based on 90 day rule. He should be able to apply on 10/20/06. Am I right?

Please advice.

Based on the date you have 01/18/2001 he was eligible to file on 10/20/2005 not 10/20/2006

I did not understand your calculation. How will it be 8 days over?

According to the website you mentioned.

I added 5 years from 01/18/2002 that gives me 01/18/2007
then I substracted 90 days from 01/18/2007 which gives me

Can you please explain the math?

Also do you have to consider 90 weekday OR just 90 days?

Isn't it just safer to give it a buffer of a week or two? Is it worth the risk to get it returned?

Don't understand the need to file on the exact date/before the date.

You're right , 90 days are calender days not working days .
I think you good to go on or after October 20, 2006. For the safe side send your application on Monday October 23,2006.

i agree with you. Its better to leave a buffer of at least a week to avoid what happened to me.
