my wife's case opened by TSC

I just checked on-line status of my wife's case and found that TSC sent a RFE to us on April 29. This means at least they are handling her 485 case. We filed together in march, 2001. My wife did her finger prints twice and our files got separated. I got my approval in march 2002 and nothing happend to her until now.

Her case details:

Thanks to Kashmir's java program from 485 CSC forum, I did a survey on src01-146 cases. I found the following facts:

There are approximately 171 I485 cases totally.

Approved/Completed ... 100 (58%)
Transferred .......... 23 (13%)
RFE Received ......... 2 ( 1%)
RFE Sent ............. 2 ( 1%)
Received ............. 35 (20%)
Denied/Withdrawn ..... 1 ( 1%)
Misc ................. 8 ( 5%)

Among the approved cases, SIX people were approved on 9/21/2001, only five months after their filing! Also the latest approvals occured on 11/21/2002 (TWO people). They are also very lucky. That was right before the freeze I believe. My wife's case was the only one among 01-146 cases that TSC touched in 2003 so far.

I ran kashmir's program and got the following error:

"Exception in thread "main" java.net.MalformedURLException: unknown protocol: https"

Did you have to set up any proxy properties/settings.
I'm running on Win2K.

I did not use proxy address at all. I am also using Win2000. I did not encounter any problems. Looks like your problem is with security http. But I don't know much java at all. You may directly ask Kashmir. He was very nice and answered couple of my questions. The following is the command line I typed when I run the program: type list.txt | java -jar kashmir1.jar > results

Also you may try the Excel program people posted on this forum. It worked for me as well.

Finally, our lawer received the letter from TSC asking for further evidence. We have not received anything. Is this normal in RFE case? Our lawer faxed a copy of the letter to us. Looks like the letter was directly addressed to him. Anyway the letter was asking us to submit evidence of maintenance of my wife's nonimmigrant status, which she has, beginning with July 1995. (This date has no significance to us at all. My wife entered US before that and never left the country). The letter is a standard one. They just checked on one of the several items. Specific things they wanted are:
a) photocopy of the Form I-797 Approval Notices for all extension and change of status.
b) photocopy of the form I-20 or IAP-66 school records(front and back including all school annotations)
c) photocopy (front and back) of the applicant's Form I-94 Arrival/Departure Record.

We hope everything is OK after this. We are a little relieved that TSC at least touched her file.
 
Z, hope its resolved and there's good news for you both soon.

Significant bit of news for all of us in that atleast some processing seems to be happening..

Spoke to my lawyer today who says that processing is definitely continuing at TSC but they are stopping short of approvals..
and that should see some movement after about 2~3 months
(didn't ask what was the basis for these observations)

I guess that you have included all the documents mentioned on RFE in your original 485 application package, haven't you? It is amazing that BCIS is requesting something already on their hand.

Did you call or ask for help from any senator/congressman or just wait for your turn?

Thanks for the encouragement. My wife's finger prints will expire in two months. We hope to see an approval. But we prepared for waiting. I have seen people waiting for over a year after RFE.
We did not contact any senators or congressmen. We certainly sent all copies (front and back) of the required documents to our lawyer. He filed I485 for us. Our lawyer said BCIS is really scrutinizing everything now. This certainly contributes to further processing delay.
Hope you will hear something soon as well.
