My wife Can she apply H1 visa? (AOS pending/3rd EAD )

My wife, her currently status is AOS pending/ applied 3rd EAD. and H-4 visa(expire on July 2004).
She can't trust NSC processing time.
Does she OK to apply H-1 visa?
Please, give me a comment.

Yes she can apply for a new H1 - only possible with a start date of Oct 1, 2004
