My wife if to be deported in two weeks UNLESS.........
Wife came as spouse to another in 91
He then husband withdrew petition during interview in 93
She and an attorney ran the course with INS into 2003
Ran appeal through Court of Appeals, lost.
I married my wife in 2002
We now have a fifteen week old son, an American citizen.
I am an American citizen by birth in America.
After lawyer gave up we submitted a "Request for Stay of Deportation" for my wife based on an high risk pregnancy. It was "Granted". Before the expiration of the "Stay" we submitted a "Request for Stay" based on breastfeeding in the best health interest of our infant son. The "Stay" was denied. My wife was told take the baby to third world/developing nation with no adequate healthcare to continue breastfeeding.
My wife has no criminal charges or convictions against her; not in USA, in her home country.
I have found out I have a serious illness during a doctor's visit yesterday. I need to know if there if possibility of "hardship waiver".
I want to know before taking our case to a lawyer Monday. There are only "fly by night" immigration attorneys in the area we live. I want to know if we will be directed to complete the right and proper forms before going to attorney.
I'd like to see a change in status for my wife since I may have long term health problems.
Anybody know the forms. I can prove up illness. I can prove up my wife is of good character. I can prove she will not be public charge.
