My dear beloved lawyer filed my I140 as EB3 by mistake, as opposed to EB2 in June last year, then he filed the amendment application asking for the correction.
It turns out VSC never combined these two filings together, in
stead of just treating them as individual case. The first EB3
one was approved in 06/26/03, but so far VSC has already
issued two RFE on the amedement one ! The lawyer responded the first RFE in May 03 stating that all the requested materials are actually with the first application, but
VSC seems never bothered to look at my first application folder, they issued the second RFE again last week...
Hi guys, isn't it an unique case? Does anybody know if
it's OK for me to withdraw my amendment one since my first
one has been approved, although it's EB3. But I'm not sure
to do so could have any impact on my approved one....
