My job might not qualify for EB1, please help!

I am a newbie here.

I was excited about my job offer, especially in this kind of economy. It's a fixed-term teaching position, however.

From what I understand, this type of position is NOT eligible for EB1. Now, if I take this offer, I will use my H-1B for at least two years because I can use OPT for the first year.

If this position does not qualify for EB1, I definitely need to find another job that will qualify me. I, then, have four year of H-1B left, considering that the extension won't be an issue. Should I turn down this offer because eventually it might backfire? I actually gave the school an oral commitment. SIGH

Is there a way to apply for EB1 through this employment?

I only have a couple of conference papers and presentations, no journal paper, no grant, no any award. I can't imagine myself using National Interest Waiver.

Please help.
 
Chances for NIW

Hi folks!

I've read the EB2 related topic on this forum, my impression is that every NIW case is unique and there is no exact rules on how to get a GC based on EB2 NIW.

I'm about to graduate with a PhD and have a postdoc offer at the national lab. After awhile I would like to apply for GC based on EB2-NIW. Please, tell me if I stand a chance, at that moment my credentials are:

-BS and MS in nuclear physics, from Ukraine;
-2 years of job experience in research in Ukraine and Germany;
-PhD in nuclear physics from USA;
-2 years at the university lab (PhD research);
-2 years at Los Alamos (PhD research);
-1 year as a postdoc at Los Alamos (I will apply after 1 year);
-the research is about advanced nuclear fuel cycle, GNEP program, fission materials, etc. Partly it's a defense related WNR (weapon neutron research), but I have no clue about WNR perks;
-13 papers in 3 countries, 10 in PhysRev and PRL, 5 - first author, 3 - on my recent work at the lab;
-papers are of recent years, so no citations so far;
-several talks, conferences, etc;
-I can acquire reco letters: 3 from Ukraine, 1 from Germany, and ~8 from the two American universities and the Los Alamos lab;
-the lab isn't exciting about any student competition on this research, so no prizes since my MS;
-a postdoc at the lab gets the money from a DOE fellowship, don't know if it's a grant or something;

Is my package realistic for getting a GC (when I'm a postdoc)? If not, what else would enhance my NIW application? If I attend the TOP10 university lab instead of Los Alamos, to do the NNSA research (on nuclear nonproliferation and GNEP), would it be better for NIW?

I am surprised that with 10 Phys. Rev. and 5 Phys. Rev. Lett, you don't have any citations yet ?.

Wait for few months to build your citations. Once it hits 20-30 mark, apply for EB2-NIW. You have a very good chance.

In addition to above listed qualifications, if you have reviewed couple of journals/papers, or if you have some major awards (like Humbolt), or if there are some media articles about you/your work (even in your local language in Ukrain), give a shot to EB1-EA too. You are likely to get through that too.

When mentioning citations, I meant my papers only, I don't keep an eye on the papers where I'm co-author. Do citations on my co-author papers count? If so, there are some.

So far I haven't reviewed anyone's papers, since I'm a grad student only, this changes for a postdoc.
And no media quotes on my research, American national labs are paranoiac about any media stuff, as well as my former institute in Ukraine, all is behind the fence, very common for nuclear physics.
Since my MS studying I have no prizes and, as of now, I'm not internationally recognized, that's why I don't consider myself qualified for EB1-EA. Correct me if I wrong.

In these threads people talk a lot about hiring an attorney to get prepared for NIW, a friend of my did so, she paid $6k!!! for the whole job back in 2005. I was wondering what are the odds of doing everything alone VS hiring an attorney? If hiring an attorney really helps and it does increase chances of success, I would rather to pay few $k's than miss a shot.
