Applying for 485-I. My father who is a resident is my patitioner.
The interviewer called us in, we sat down, but then he told us to stand up to do the swear in. We did, then he started going through the paperwork the lawyer had sent, He asked me questions like my name, age, DOB, if I had ever been in trouble. Then he said, he could'nt approve my case because I had reached the age limit. Immediately my attorney interrupted and said that that could'nt be because we had filed before I turned 21. The priority date was printed way before my 21st B-day. He said ok, but that he had ran the paper through the system and that the system had said NO. He also said there was no visa available for me, but the attorney again said yes that there was, then he checked in some book and he said, oh yeah ok.
Prior to this he told us he had talked to his supervisor and that the supervisors response had been the same, that it was a NO. But then the attorney asked if he could talk to him, and the man said no because he was at some meeting. So my attorney left him a note with his point of view, what he thought, what he knew. That I cant be denied cause we filed before I turned 21. The man said ok, that he would talk to him tomorrow, cause he had to go home, he was sick.
That he was going to let us know about the decision by mail. Then my attorney told the man, Mr. Garcia I've know this young man ever since august and I can tell you, he really deserves this, he speaks perfect english, he went to school, he's neer been in trouble. The man responded, I understand, and it's always easier to approve cases than to deny them, but I cant go against the law. That he'll talk to his supervisor. My attorney told me that in the event that they said no, that we were going to go into some ATA trial which I dont know what that means. All this is really weird, if he knew I was denied from the beginning, why bother to go through the interview? Why waste his time? Plus my attorney had a point there, about filing before I was 21. Even I read that on the internet. sO I DONT KNOW WHAT TO THINK ANYMORE. I dont know, I still have hope and optimism.
So to conclude the attorney told me to not worry, that he knew Mr. Sauceda, the supervisor, and that the good thing is that I did'nt have to go back to my country. But it's sad because I really wanted to get my workers permit
