My incomplete DV-2006 experience

I hope somebody can use this as a help. We still waiting for news from USCIS...

INTRODUCTION:
Family of 4. Husband with L1 visa and wife and 2 kids with L2.
Our L1, L2 visas expiring on September 25, 2005
I-94 for wife and kids expired already (we came as turists and change stust to L2 here)
I-94 for husband expiring July 2006
We started a AOS by Employment in the beginning of 2005 with a lawyer.
Case was denied in september 2005 because the company sponsoring my husband gave us some "dubious" papers
( :-O tell me about it, my husband left the company after that).
So at the moment DV started we had L1, L2 visas expired by 5 days. You're suppouse to have 60 days to left the country or change your status
We were quite concern about it because our not complete knowledge of the law in that situations


Cover letter at top of everything= addressed to the chicago office,
RE: application to adjust status based on DV for family. we won the lottery, husband, wife, 2
children. we are filling for aos, and enclosing fees and forms 485 and
suplement A(just our case the suplement .. in case the 5 days overdue could put us in a situation requiring this),
i765 to ead's, blabla..KCC advised me to apply as soon as possible...Reference to enclosed documents signed address at the bottom
it's just a summary, the letter is short and properly presented.

Husband
Yellow Cover with PRINCIPAL NAME , AOS APPLICATION DV LOTERY CASE #
Form 765 with photos(2), money order, copy of passport, visa and
previous EAD card.
Form 485 with fees and photos(2),
Form 485 sup A with fee (just for our case)
copy Acknowledge from KCC, copy of receipt sealed, copy of winning
letter. (we attach also the 230 &122 forms copies but isn't necessary)

Each person have a package with acco fastener, we made the holes in the
upper side centered and put the pages in the fasteners. them we put all
together with a rubber band. and the cover letter at top.

All the forms have written the diversity case number in the corner.

NOA= Notice of Action = The notification when they receive your case, have your case number
AOS= Adjustment of Status = Is when you're doing your residence process inside the US wit hall the odds you can have
Consular procesing = when you do your case from your home country
FP = Fingerprints = Biometrics = Photo and fingerprints records they took in ASC. validity last 1 year.
Medicals = Medicals results you have from an authorized doctor, stating you dont have nothing that put in danger anothers. thy last 1 year. NEVER open the envelope the dr gave you with those. better ask the doctor for a copy.
ASC = Application Support Centers = office where they took your FP and photos.

Tip = Once you have your case number, Sign up in the uscis case online, register you case(s) number(s) and you'll have an all-in-one access to your online case status..not always up to date but HELPS.



My case:
0. Middle of May we received the Winner Letter.
1. Sent package on sep 30, 2005
2. Package received on chicago on Oct 01,2005
3. NOA Received Date: oct 02, 2005. Receipt Date: Oct 14, 2005, we received the NOAs by mail on Oct 17(all of us but my son)-18(my son)
4. Fingerprint Scheduling notice(just my husband), Date: nov 07,2005 from miami office. We received the mail on nov 09, 2005 with a open schedule(I mean said,..go to the asc on the next 87 days)
5. Nov 10, 2005. My husband fingerprint were taken.
6. Dec 06, 2005. Call USCIS to ask for my FP appointment. The guy just got rid of me without do anything.
7. Dec 06, 2005. Got an appointment to Miami office with infopass for Dec 21,2005
8. Dec 14, 2005. Call the FBI on to ask about the FP. My husband's are done and sent back to USCIS. They have mine done in May (from my previous case) but nothing with new case.
9. Dec 21, 2005. Went to Miami Local Office. About the FP they said they cant do anything and gave me a general Inquiry form to write to Missouri office. About EAD, they didn't help either because the case was in its regular processing time, ask us to wait until 90 days are past.
10. Jan 03, 2006. Try several times to call USCIS and cant reach the officer.
11. Jan 04, 2006. Call again USCIS, ask about EAD and FP. Operator doesn't help, ask us tu wait until 90 days to EAD and 120 days for FP. Can't reach the officer
12. Jan 06, 2006. Read in the uscis page that if USCIS fails in the issue of EAD in 90 days, we have the right to ask for a Interim EAD. We made infopass appointment for both in Miami office (this time other location- Main Building)
13. Jan 17. 2006. We sent the general inquiry to misoury, and also a letter to Senator Mel Martinez asking for help.
14. Jan 18. 2006. Went to USCIS main building in Miami at 830am (infopass appointment at 10:20am) they let us go in and the officer ask for our receipt notices and infopass. We sat at the waiting room, she call us by name and told us our EAD cases had been approved on 12/14/2005, but they were waiting for biometrics to issue the card. She took our photo and index finger fp right there, made a biometrics stamp in ours receipts notices, stapled the printscreen with our case approved and ask to wait 2-4 weeks for our card. Ask about my FP missing for 485 she can't do anything.
- Went to venezuelan consulate in Miami to renew our passports (I'm a little nervous, we had to left our passports there and the'll send us them by mail).
- Decided to go to the ASC to try to ask if my fp were issued and lost or not issued at all. get in there at 2:30pm, ask for the officer to ask a question. fortunatelly the office was almost empty. Talk with the officer explained situation, she checked my case and my husband's at the computer, told me that in the next week a lot of schedules would be send and decided to make my FP right there, and told if my schedule get in the mail, please ignore it. They did my fp code 3, everything, stamp my 485 receipt noticed. was a big advance in this day.
15. Jan 21, 2006. FP Schedules letter were received for me and the children in Hialeah office on 02/02/2006
16. Jan 24, 2006. The EAD's Cards arrived by mail. duration 1 year
17. Feb 02, 2006. We went to ASC, th office almost empty again, amazing. they took my children FP (code 2 - photo , index and signature). For me? they just confirm to ignore because they had already my FP. we spent there less than 20 minutes.
17. Feb 07, 2006. We received letter from Senator Mel Martinez, the inquiry of help was redirected to his miami office, somebody will contact us to se how can help us.
18. Call the KCC to ask how is the timeline to have the interview. The lady told us we have to wait until the number is current, after that if we don't receive the interview letter, we can contact uscis to ask for an interview...
19. Call USCIS. After fooling the operators, they put me in wait to the officer. She checked on our records and found that my case was already in miami office, however my husband(the principal) and my children cases still in Missouri. She made an inquiry to Missouri office about those cases and to comunicate with us to inform about the status and why they only sent mine to Miami.
told me to wait 30 days for a mail from missouri with the status and a notification about the dates to send the cases to miami office. and after that, depending of the criteria of the adjudication officer at Miami, they could send us a schedule to an interview or a decision about the case if the interview wasn't necessary for us. I found out the checks they do are: IBIS Name Check,FBI Fingerprint Check and FBI Name Check
20. April 7, 2006.Call Senator office to ask if they can make an inquiry 180 days have been passed and no news.
21. Got infopass for april 20, canceled for work issues and rescheduled for april 28
22. April 25, 2006. Call again to USCIS, can reach officer he just comfirm my case is in Miami and the rest of the family in missouri, but he said..is in the National Record Center.. ??
23. April 28, 2006. Go to the infopass appointment in information office. 4 hours waiting for 7 minutes of insults. A non-nice officer attend us, we try to explain about the case and what the officer at the phone said. She only respond You know nothing, USCIS have its own procedures and you dont know.she complain about the children not being there. when we mentioned the national record center, she asked for my husband record and asked him to go again in 4 weeks.at least that was our goal but was a really disapointed experience.
24. May 16, 2006. My husband made an appointment with infopass for may 30 in information office. no news so far about senator or uscis.
25. May 19, 2006. Contact senator's office, sent fax with new inquiry, new person in our case.
- Call uscis.was transfered to the official. she checked the four A# records in the system. My husbands and mine are already in Miami office, the children's records still in Missouri. The officer sent and inquiry-note telling that the kids'cases were Diversity lottery cases and should be sent to miami. told us to wait 30-60 days to have news about inquiry.
26. May 29, 2006. USCIS Appointment. My husband went with all the paperwork and document supports.
They had a really mess between the previous denied case and the new one. They after the explanation and papers in hand realized that our lottery cases are ok are all in main Miami office but waiting to be current to be processed.
she told my husband that we have to wait, but the numbers available are lows and our case is high.and might not be current before september.. you have to wait for luck.. ohh what a solution..
27. Jul 17, 2006. Because the august bulletin is not published yet, we Call to KCC to ask the advance cuttoff number for SA in september, she answered, that all numbers are going to be current, contact your immigration office to ask for your interview. The bulletin was published at 3pm everybody is current.
28. Jul 19, 2006. Call USCIS. 1st operator help null. she put me in hold to check my info and hang up the call. SWEET!!
- Call Again operator made an inquiry over the family cases asking miami office what going on with the process now the visa number is current.
- Call Senators office and they said our cases were confirmed in miami in processing, they'll send us a letter.
29. Jul 22, 2006. Letter received from senator stating USCIS informed him that our cases were in miami office.
30. Aug 14, 2006. Call USCIS. The operator told me to call again in 5 days if I not receive nothing by saturday aug 19,2006 in my mail.
Call USCIS (my husband) operator made an inquiry and ask to wait 60 days.
