Do do you know your Lin# so quickly?
My attorney mailed out my I-140 two weeks age. INS cashed my processing fee check Mar. 3. 2003. What time can I Lin#?
I am waiting and want file I-485 immediately if I get receipt for I140.

I am not filing I-485 concurrently.
My category is EB3/RIR.
 
I live in MI. My Labor Certificate ws approvaled in Jan. 24 from Chicago. My case is EB3/RIR too.

I am monitering my own bank account and know the INS withdrew the money from account on Mar. 3.

I want to file I485 myself without attorney. That's why I anxious to get I-140 receipt.

Why do not you file I-485 concurrently?
 
Just because

my lawyer and I agreed it seems like taking a long time for I-485.
also my H1 will expire on Dec 2003.
therefore, it was more practical for me to go with consular process (takes approx. 6 month after the approval of I140), rather than AOS I-485.

As long as I could return to US with my valid H1 after the interview at consular, I think I'm in good shape.

ok. contacted my lawyer and it took 2weeks to get a receipt.

Sent I-140 on 2/19/03 by Fed'ex
Received date 2/24/03
Notice date 2/25/03
Laywer received the notice on 3/5/03

it was about two weeks. I-140/EB3/non-concurrent

about your question of I-485, did my response made sense?
or have I misunderstood the advantages of filing I-140/I-485 concurrently,

If you can see the back of the check, (online if you have Bank One Account), you can find your LIN number there.

Can one file I-140 based on a Labor Cert. from Chicago?

What is a WAGE 1 occupation??
 
I am new to this board. Can any one help ME in the procedure to find the status of my application for I-140? My RD is 01/21/03 and I have only the A# with me and I do not have the LIN#. I knew this A# , through the FP notice I got from INS.

I will explain my LC situation and level 1 job altogether

Level 1 job means that the level of prevailing wages. In order to obtain a labor certification by RIR, we need to prove your job would pay you level 2 prevailing wages that means you have an ability to perform the specific duties INDEPENDENTLY WITHOUT SUPERVISION.
Because I am in social service field, unless you have a Master's degree and Professional license to practice counseling, my company (and most of place in this field) normally DOESNT offer level 2 wages for employee who doesn’t have an independent license. I have a BS and 2 years of experience, and moreover my company wasn't able to find a staff for the position I have for almost 1 year.

Also the DOT includes wide ranges of job responsibilities into one for counselors. This means the private practice counselor who charges $200 per session and a substance abuse counselor who's annually salary is less than 25K is classified in the same categories for prevailing wages.

My status was satisfying most of requirement for RIR except prevailing wages issues that I mentioned above.

My lawyer and I decided to argue about this. So we did send a nice letter explaining the current situation in the particular labor field and argued that I should be qualified to Labor certification even though it is level 1 wage job, since it is clear the labor is severely short in this field.

When DOL approved my case without any sort of questions, my lawyer was also very, very surprised and told me this is extremely rare for them to pass this case without a battle.
