My I-140 Approval

Thanks guys for your inputs, My 140 (labor substitution) is approved today after 2 rfes. I will give details later about my case.
 
Hi jai,

What were the two RFE's about? Any LUD Changes after you submitted Replies to the RFE and before the actual I-140 approval?

Would appreciate if you can give the full details chronologically.

Ok Here are my details.

I applied I-140 (Labor Substitution) on 25th June 2003 with Photocopies of Labor Certificates. I didn't know at that time that I-140 is already approved for previous employee on this LC.

On May 12 2004 I got first rfe to submit original Labor department form ETA750A and B.
I called company's attorney and he mailed me the I-140 approval of previous employee approved on this LC.

on July 7 2004 my employer sent a notarized letter requesting to revoke the approved I-140 of past employee and substitute me as beneficiary.

LUD changed July 29 2004,
Applied for I-485/EAD/AP on 2nd August 2004.
I-140 LUD Changed
Got EAD/AP approved in 15 days
I-140 LUD changed 4 days in a row.

Got 2nd RFE on Sept. 14 to submit ETA750B with substituted alien information.

replied on Sep 16 2004

No LUDs

Approved on Sep 29 2004

Priority date on LC was March 1997 and I joined this company in Jan 2003. I was getting more than preferred wage from day one. but I was worried about the ability to pay issue, as it has to be determined from labor priority date which is March 1997. But I got lucky.

My case is of labor substitution and i have received RFE for submission of orifinal labor Certification which is lost.We had filed with photocopies of the original.I-140 for the Original beneficiary was never filed.

My lawyer replied on 09/21/04 and i have had LUD's on 09/27 and 09/28 without any status message changes.

I am wating very nervously to see what is in store ahead.

In your case USCIS should request original labor from DOL. But my friend it takes a long time (you know DOL) Why don't you request sanator or congressman to send a letter to DOL to expedite the process. I am sure sooner or later you will be approved.

Today I gave papers to paper to lawyer to file I-140 (labor substitute). I gave him following papers.

1. Resume
2. Experience letter
3. Last 2 years W-2 forms
4. Recent 4 pay stubs
5.Form I - 140
6.Letter in support of the petition
7. Application of Alien employment certification -part -b -statement of qualification of alien
8. Notice of entry of appearance as attorney (G-28)

Does he need any more information from me.?

Where lawyer will mention about labor substitute thing?

I am little bit nervous. I just want to make sure either I or lawyer does not miss any thing?

I think two things are missing.
1. if your company has < 100 employees then you should send latest company tax returns to avoid abaility to pay issue (More details you can find from thread "how to overcome ability to pay issue" by UnitedNations)

2. Original approved DOL form ETA750A and B on which you are seeking substitution. Otherwise you will have rfe for sure to submit it.

My attorney did not ask me Resume and Experience letter, do those have to be included in I-140 application? Thanks.

Lawyer needs resume to prepare "Letter in support of the petition" and
"Application of Alien employment certification -part -b -statement of qualification of alien". I guess if he has all required information then he do n't need information.

Experience letter they attached with I-140 form application.
