My H1B status - Need to go to India on Family emergency

Hi All

Please help..

I am working for company since 2001. I am in currently in 7th year of my H1. My H1 is valid till Feb 2, 2007 and visa also stamped till Feb 2, 2007.

I have my labor and 140 cleared from my company. Waiting for my PB to be current

My company already applied for H1 Extension for another 3 years as I have 140 cleared. H1 extension is applied June 2006. I am waiting for my H1 renewal.

Now I have a Family emergcency and I need to go to India for a week or 10 days.

What are my options? Can I go to India and come back using my Current Visa stamping and H1?

What happens if my H1 is approved in the next week? Do I need to go for Stamping in India?

What happes if my H1 extension is approved while I am in India?

Please help and provide your suggestions

Ask your Lawer

I would ask my lawer as they have filed for extension. During this time they do not recomend you to travel but there are ways you can do that.

As far as stamping you should be ok as your current stamping is until 02/07- Good Luck-A
