My H1 is issued till july 2008, where I should have got only till 2007

Hi all,

I am in my 5th year on my H1 and last year I changed the company, and they sponsored the H1 for me. Now, i dont know whos mistake is it, but my H1 was issued till July/2008. I had a doubt regarding the end date so I calculated the days I was in the US, so, the remainig days would come to July/2007.

now my question is:
1. Do i have to inform the INS (or DHS or whatever) that I got way too much duration to stay here in US, on my H1?

2. Would it be our resposibility as an individual to take care of the days left for the completion of 6years term??

3. What is my way out, if its a serious problem?

Kindly clarify my doubt. I asked the lawyer that represent the company, and i did not get a satisfactory response. She asked me to go to india, tell the counsular that there is a mistake in the date, and get stamped (h1 visa) till july 2007 and return. (actually My visa expired, and i dont have one for this current H1). I think she thought i was too ignorant about this whole thing.

please replay, any response would be greatly appreciated.

If USCIS has issued you an extention of extra year by mistake they it is our responsibility to correct it. The best thing is, keep the approval with you and treat it as if the I-94 is valid till July 2007. You have to apply for extension between Jan 2007 till July 2007 with start date of July 2007. While applying for extension, ask attorney to mention about such mistake in attorney cover letter. I had the same issue and that's what we did. I noticed an LUD change on my previously approved H1 as soon as they received my attorney's cover letter. I am sure the LUD was to correct the dates.

In case, if you change company and file H1 transfer before you file extension then you don't have to do anything.

Thanks for the clarification. I however have a doubt, If i change the company, i need not worry about the mistake, right? cause in the new H1 with this new company, i need to give the right dates, thereby rectifying the dates issue.
am i correct?
