My Friends GC is approved!!! Concurrent Processing

My Friends GC is apporved yesterday, concurrent NSC

I-140/I485 RD OCT-2003.


He is going to india tomorrow and had Valid H1-B Status. He was in H-1b never used EAD or AP. Can he travel and come back without any problem.

He is planning to get married. Will there be any problem

I'm not 100% sure, but when his I-485 was approved, his H-1B might have become invalid. Since he doesn't have a I-551(?) stamp in his passport, he may have a problem coming back in. He should contact his lawyer before he leaves the country.

If he has valid H1 and has not got the GC stamp yet, he can still re-enter. My friend's wife did the same. The H1 stamp is not invalidated until I-551 is stamped.

If he is over 21 there won;t be any problem in marrying anyone over 18 in India;) However it is doubtful if he can sponser H-4 for his spouse from India. Also, he can't add dependents to I-485 once his petition has been approved.

Oct 2003 is it Nebraska or california center??? Cant' be NSC dude. Don't tell me its NSC.
He CAN'T bring his wife to US with him unless she has some visa L/h/f.
 
what is so hard to believe in the fact that it is oct 03. NSC is supposed to approve concurrent filed cases whose fp is done according to the new FO memo. its high time they started doing that.
 
Anything is possible with USCIS and especially NSC. There are reports of cases from 2004 getting approved. I remember reading them in this forum.

Tilldate 4 NSC Feb'04 Concurrent I-140/485 approvals happened so far..
