Hi I have a friend that his situation goes like this.
He lives with his wife in an aparment where her sister shares the apartment with them. Both her sister and she has a children. Her sister has a little girl and her a 5 year old boy and a two year old Daughter with my friend. The situation goes like this.
He recently got his conditional green card on January 29th of 2009. But things are not going that well in his marriage. His wife's sister, wife and friends go to party often and he doesn’t agree with it because they start fighting and then at the end everything turn down to him. They stared making fun of him,
Yelling at him, tell him he is a mother ****er, hide his green card and documents. She doesn't want to move out with him so they can life together as a couple without her sisters around. One of her sisters live with them inside the apartment and the other live in the apartment above them in the same building. They drink, smoke and all of that stuff which is ok if they would turn it to him at the end.
Last night he had to call 911 because they seemed like they were going to eat him alive. The police came and he talked to a police man and he said to go somewhere else to sleep for the night and return back tomorrow to look for his documents, and in case she doesn't give it to him to call him back. A police woman showed up to the scenario later on and she wanted to arrest him, and told her r how come are trying to arrest me if I am complaining about what they are doing to me. The police man said go away for the night and come back tomorrow if she doesn't give you your documents then call me at 8:00 am.
What do you think guys of this situation?
Does it qualify as a Domestic violence case? and in case it qualifies when or how can he go about applying for a waiver?
