My fiance had overstayed on her 3 month visit visa by over a year. This was 3 years ago.
Now that we are getting married this year, we will be filing her h-4 application since i will be getting my h-1B
Can her past run in with immigration (on her visit visa) be cause for refusal of entry when she accompanies me to the US as my spouse on an h-4 visa??
She will be my dependent (on a h4 visa), can she still enter the country despite overstaying 3 years ago on her visit visa? (she over stayed by 1 year)
Will appreciate any first hand account of a similiar situation and what options i have to ensure that she isn't refused entry into the US or her h-4 application.
