My experience at port of entry

Hi,

Those of you who did not recieve a receipt for your I485 application may find this posting useful.

I did not recieve a receipt for my I485 application filed in Oct 99. My case was approved on May 21st 01,I have not yet stamped my passport so technicaly I\'m still on H1. I recently went to India on vacation and a lot of people adviced me that I might have problems re entering as I did not have my I485 receipt. I however had no problems at all. The INS guy at the airport just looked at my H1 and then stamped my passport.

On the advise of my lawyer I was carrying my approval notice and a letter from my lawyer explaining that I did not recieve the receipts. None of these were however required.

I hope this info is useful to some of you in a similar situation.

The advise from lawyer is good. In case you have problem, you would have suffered a lot at POE. You won\'t be released, perhaps it may range between 2 - 6 hours, until INS guys make sure that you are a legal entrant.

Think on the other way. Had you got some kind of problems, you would be scolding your lawyers. I do not basically accept that I-485 receipt is not necessary at all. However, if you have AP, it is not required.

I have heard two of such delays on SFO airport, one I witnessed more than 6 hours waiting when my relative was held for different reasons. I still remember the 6 hours at SFO even after two years.
