My brother was petitioned by my LPR mom back in 1996,as F2B (unmarried son, 21 yrs older) the petition was approved within a few months. Later in 1998, my mom became a naturalized citizen. ( she never upgraded the petition nor informed NVC.) Then, a year later, he said he got married.
What happens to the petiton, Is he able to keep his old priority dates? or will he be converted to F3?His priority dates are now current. But we are still processing papers for consular processing in Manila.Will he be able to take advantage of CSPA (child status protection act) sons of naturalized citizen will be able to keep their priority dates, does he need to send a letter now before the interview, or wait til then?
